CIRCULAR

annulment of some regulations related to issuance, reissuance and withdrawal of permits of Circulars on international road transport promulgated by the Minister of transport OF VIETNAM

Pursuant to the Law on Promulgation of Legislative Documents dated June 22, 2015;

Pursuant to the Law amending certain articles of the Law on Promulgation of Legislative Documents dated June 18, 2020;

Pursuant to Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government of Vietnam elaborating on certain Articles and measures for implementation of the Law on Promulgation of Legislative Documents;

Pursuant to Decree No. 12/2017/ND-CP dated February 10, 2017 of the Government of Vietnam on function, tasks, powers and organizational structures of the Ministry of Transport of Vietnam;

Pursuant to Decree No. 154/2020/ND-CP dated December 31, 2020 of the Government of Vietnam amending certain Articles of Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government of Vietnam elaborating certain articles and measures for implementation of the Law on Promulgation of Legislative Documents;

Pursuant to Decree No. 119/2021/ND-CP dated December 24, 2021 of the Government of Vietnam on procedures for issuance, reissuance and withdrawal of permits for cross-border road transport;

The Minister of Transport of Vietnam promulgates a Circular on annulment of some regulations related to issuance, reissuance and withdrawal of permits of Circulars on international road transport promulgated by the Minister of Transport of Vietnam.

Article 1. Annulment of some Articles, clauses, phrases and appendices of Circulars of the Minister of Transport of Vietnam guiding implementation of certain articles of the Agreement on facilitation of cross-border transport of goods and passengers in Greater Mekong Subregions (GMSs).

1. Some articles, clauses, phrases and appendices of Circular No. 29/2009/TT-BGTVT dated November 17, 2009 of the Minister of Transport of Vietnam guiding implementation of certain articles of the Agreement on facilitation of cross-border transport of goods and passengers in Greater Mekong Subregions (GMSs) shall be annulled such as:

a) Annulment of Clause 4 of Articles 4, 6, 7 and Appendices 2, 5, 6, 7, 8 and 9;

b) Annulment of the phrase “Mẫu ký hiệu phân biệt quốc gia của Việt Nam được quy định tại Phụ lục 2 ban hành kèm theo Thông tư này” (“The distinguishing sign of Vietnam is provided in Appendix 2 enclosed with this Circular”) specified in clause 2 of Article 4.

2. Annulment of clauses 1, 2, 3, 4, 6 and 7 of Article 1 and Appendices 1, 2, 3, 4 and 5 of Circular No. 89/2014/TT-BGTVT dated December 31, 2014 of the Minister of Transport of Vietnam amending some articles of Circular No. 29/2009/TT-BGTVT dated November 17, 2009 of the Minister of Transport of Vietnam guiding implementation of certain articles of the Agreement on facilitation of cross-border transport of goods and passengers in Greater Mekong Subregions (GMSs).

Article 2. Annulment of some Articles, clauses, phrases and appendices of Circulars of the Minister of Transport of Vietnam guiding implementation of Agreements and Protocols of road transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China

1. Some Articles, clauses, phrases and appendices of Circular No. 23/2012/TT-BGTVT dated June 29, 2012 of the Minister of Transport of Vietnam guiding implementation of Agreements and Protocols of road transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China shall be annulled such as:

a) Annulment of Articles 8, 9, 10, 11, 12, 13, 14, 15, 16 and 17 and Appendices I, V, VI, VII, VIII, IX, X, XI, XII, XIII, XIVa, XIVb, XIVc, XIVD, XIVdd, XIVe and XIVg;

Annulment of clauses 4, 5, 6 and 7 of Article 1 and clause 3 of Article 2 of Circular No. 29/2020/TT-BGTVT dated October 30, 2020 of the Minister of Transport of Vietnam amending some articles of Circular No. 23/2012/TT-BGTVT dated June 29, 2012 of the Minister of Transport of Vietnam guiding implementation of Agreements and Protocols of road transport between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China.

Article 2. Annulment of some Articles, clauses, phrases and appendices of Circular No. 88/2014/TT-BGTVT dated December 31, 2014 of the Minister of Transport of Vietnam guiding implementation of some articles of Agreements and Protocols implementing the Agreement on facilitation of cross-border transport of road vehicles between the Government of the Socialist Republic of Vietnam and the Government of Lao People's Democratic Republic

1. Annulment of clause 1 of Articles 4, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18 and 19 and Appendices 2, 3, 4, 5, 6a, 6b, 7a, 7b, 8, 9, 10, 11, 12, 13, 14, 15, 16 and 17.;

2. Annulment of the phrase “Mẫu ký hiệu phân biệt quốc gia của Việt Nam quy định tại Phụ lục 2 của Thông tư này.” (“The national distinguishing sign of Vietnam is provided in Appendix 2 of this Circular.”) specified in Article 6.

Article 4. Annulment of some Articles, clauses, phrases and appendices of Circulars of the Minister of Transport of Vietnam guiding implementation of Agreements and Protocols implementing the Agreement of road transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia

1. Annulment of clause 1 of Article 5, clause 2 of Articles 7, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19 and 20 and Appendices 2, 3, 4, 5, 6A, 6B, 6C, 7A, 7B, 8, 9, 10, 11, 12, 13, 14, 15, 16 and 17 of Circular No. 39/2015/TT-BGTVT dated July 31, 2015 of the Minister of Transport of Vietnam guiding implementation of some articles of Agreements and Protocols implementing the Agreement on road transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

2. Annulment of clauses 3 and 4 Article 1 of Circular No. 47/2019/TT-BGTVT dated November 28, 2019 of the Minister of Transport of Vietnam amending some articles of Circular No. 39/2015/TT-BGTVT dated July 31, 2015 of the Minister of Transport of Vietnam guiding implementation of some articles of Agreements and Protocols implementing the Agreement on road transport between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia.

Article 5. Annulment of some Articles, clauses, phrases and appendices of Circulars of the Minister of Transport of Vietnam guiding implementation of some articles of the Memorandum of Understanding between the Governments of the Kingdom of Cambodia, the Lao People's Democratic Republic and the Socialist Republic of Vietnam on road transport

1.  Some Articles, clauses, phrases and appendices of Circular No. 63/2013/TT-BGTVT dated December 31, 2013 of the Minister of Transport of Vietnam guiding implementation of some articles of the Memorandum of Understanding between the Governments of the Kingdom of Cambodia, the Lao People's Democratic Republic and the Socialist Republic of Vietnam on road transport shall be annulled such as:

Annulment of clauses 1, 2, 3 and 4 of Article 1 of Circular No. 20/2020/TT-BGTVT dated September 17, 2020 of the Minister of Transport of Vietnam amending some articles of Circular No. 63/2013/TT-BGVT dated December 31, 2013 of the Minister of Transport of Vietnam guiding implementation of some articles of the Memorandum of Understanding between the Governments of the Kingdom of Cambodia, the Lao People's Democratic Republic and the Socialist Republic of Vietnam on road transport.

Article 6. Implementation clauses

1. This Circular comes into force from May 25, 2022

2. Chief of the Ministry Office, Chief Inspector of the Ministry, Director Generals of Directorate for Roads of Vietnam, Director Generals, Directors of Departments of Transport and Departments of Transport-Construction of Provinces or central-affiliated cities, heads of relevant agencies, organizations and individuals are responsible for the implementation of this Circular./.
