    HƯỚNG DẪN THỰC HIỆN NGHỊ ĐỊNH SỐ 12/2006/NĐ-CP NGÀY 23/01/2006 CỦA CHÍNH PHỦ QUY ĐỊNH CHI TIẾT THI HÀNH LUẬT THƯƠNG MẠI VỀ HOẠT ĐỘNG MUA BÁN HÀNG HOÁ QUỐC TẾ VÀ CÁC ĐẠI LÝ, MUA, BÁN, GIA CÔNG VÀ QUÁ CẢNH HÀNG HOÁ VỚI NƯỚC NGOÀI TRONG LĨNH VỰC NÔNG NGHIỆP, LÂM NGHIỆP VÀ THỦY SẢN

    Căn cứ Nghị định số 01/2008/NĐ-CP ngày 03 tháng 01 năm 2008 của Chính phủ qui định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;
    Căn cứ Nghị định số 12/2006/NĐ-CP ngày 23 tháng 01 năm 2006 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hoá quốc tế và các hoạt động đại lý, mua, bán, gia công và quá cảnh hàng hoá với nước ngoài;
    Căn cứ Nghị định số 32/2006/NĐ-CP ngày 30/3/2006 của Chính phủ về quản lý thực vật rừng, động vật rừng nguy cấp, quý, hiếm;
    Căn cứ Nghị định số 82/2006/NĐ-CP ngày 10/8/2006 của Chính phủ về quản lý hoạt động xuất khẩu, nhập khẩu, tái xuất khẩu, nhập nội từ biển, quá cảnh, nuôi sinh sản, nuôi sinh trưởng và trồng cấy nhân tạo các loài động vật, thực vật hoang dã nguy cấp, quý, hiếm;

    Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn việc xuất khẩu, nhập khẩu các loại hàng hoá thuộc diện quản lý chuyên ngành nông nghiệp như sau:

    Chương I

    QUY ĐỊNH CHUNG

    Điều 1. Phạm vi điều chỉnh

    Thông tư này qui định trình tự, thủ tục xuất khẩu, nhập khẩu hàng hoá thuộc diện quản lý chuyên ngành nông nghiệp, lâm nghiệp và thủy sản gồm:

    a. Xuất khẩu gỗ, sản phẩm gỗ từ rừng tự nhiên trong nước; củi, than làm từ gỗ hoặc củi có nguồn gốc từ gỗ rừng tự nhiên trong nước;

    b. Xuất khẩu, nhập khẩu động vật, thực vật hoang dã nguy cấp, quý, hiếm;

    c. Xuất khẩu, nhập khẩu giống cây trồng;

    d. Xuất khẩu, nhập khẩu giống vật nuôi;

    đ. Xuất, nhập khẩu thuỷ sản sống, thủy sản làm giống;

    e. Nhập khẩu thuốc thú y, nguyên liệu làm thuốc thú y, vắc xin, chế phẩm sinh học, vi sinh vật và hoá chất dùng cho động vật và thủy sản;

    g. Nhập khẩu thuốc bảo vệ thực vật (BVTV), nguyên liệu thuốc BVTV và sinh vật sống trong lĩnh vực BVTV;

    h. Nhập khẩu thức ăn chăn nuôi (TACN) và nguyên liệu TACN; thức ăn thủy sản (TATS) và nguyên liệu TATS;

    i. Nhập khẩu phân bón và các chế phẩm phân bón;

    k. Xuất khẩu, nhập khẩu nguồn gen cây trồng, vật nuôi, vi sinh vật phục vụ nghiên cứu, trao đổi khoa học, kỹ thuật.

    Điều 2. Nguyên tắc thực hiện các qui định về kiểm dịch động vật, thực vật, kiểm tra đối với hàng hóa nhập khẩu

    1. Hàng hoá nhập khẩu thuộc diện kiểm dịch động vật, thủy sản, sản phẩm động vật, sản phẩm thủy sản, trước khi thông quan, phải thực hiện quy định tại các quyết định của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn/Bộ Thủy sản (cũ) ban hành Danh mục đối tượng kiểm dịch động vật, kiểm dịch thủy sản, sản phẩm động vật, sản phẩm thủy sản; Danh mục động vật; Danh mục thủy sản, sản phẩm động vật, sản phẩm thủy sản thuộc diện phải kiểm dịch và Quy trình, thủ tục kiểm dịch động vật, kiểm dịch thủy sản, sản phẩm động vật, sản phẩm thủy sản, kiểm tra vệ sinh thú y.

    2. Hàng hóa nhập khẩu trong Danh mục vật thể thuộc diện kiểm dịch thực vật trước khi thông quan phải thực hiện quy định tại các quyết định của Bộ Nông nghiệp và Phát triển nông thôn về việc công bố Danh mục vật thể thuộc diện kiểm dịch thực vật của Việt Nam, Danh mục đối tượng kiểm dịch thực vật của Việt Nam, Danh mục vật thể thuộc diện kiểm dịch thực vật phải phân tích nguy cơ dịch hại trước khi nhập khẩu vào Việt Nam, ban hành quy định về các thủ tục kiểm tra vật thể và lập hồ sơ kiểm dịch thực vật.

    3. Trường hợp cửa khẩu chưa có cơ quan kiểm dịch động, thực vật thì hàng hoá được thông quan theo cơ chế đăng ký trước, kiểm tra sau. Cơ quan kiểm dịch có thể kiểm dịch cùng lúc Cơ quan hải quan kiểm tra hàng hoá hoặc kiểm dịch sau khi hàng hoá đã hoàn thành thủ tục hải quan theo thời gian và địa điểm được xác định trong giấy đăng ký kiểm dịch.

    4. Việc kiểm tra chất lượng thuốc BVTV và nguyên liệu thuốc BVTV thực hiện theo hình thức đăng ký trước và kiểm tra chất lượng sau khi thông quan.

    Chương II

    QUY ĐỊNH CỤ THỂ

    Điều 3. Xuất khẩu gỗ và sản phẩm gỗ; củi, than làm từ gỗ hoặc củi có nguồn gốc từ gỗ rừng tự nhiên trong nước.

    1. Cấm xuất khẩu gỗ, sản phẩm gỗ rừng tự nhiên trong nước (trừ những trường hợp qui định tại các khoản 2 và 3 Điều này), gồm:

    a. Gỗ tròn các loại.

    b. Gỗ xẻ các loại.

    c. Sản phẩm làm từ gỗ thuộc diện nguy cấp, quý, hiếm thuộc nhóm IA (trừ gỗ là tang vật xử lý tịch thu theo quy định hiện hành của Nhà nước) quy định tại Nghị định số 32/2006/NĐ-CP ngày 30 tháng 03 năm 2006 của Chính phủ về quản lý thực vật rừng, động vật rừng nguy cấp, quý, hiếm; sản phẩm làm từ gỗ quy định tại Phụ lục I của Công ước về buôn bán quốc tế các loại động vật, thực vật hoang dã nguy cấp (Công ước CITES).

    2. Xuất khẩu sản phẩm gỗ theo điều kiện hoặc theo giấy phép:

    a. Sản phẩm làm từ gỗ thuộc loài nguy cấp, quý, hiếm nhóm IA là tang vật xử lý tịch thu theo quy định hiện hành của nhà nước và nhóm IIA quy định tại Nghị định số 32/2006/NĐ-CP ngày 30/3/2006 về quản lý thực vật rừng, động vật rừng nguy cấp, quý, hiếm chỉ được phép xuất khẩu ở dạng sản phẩm đồ mộc hoàn chỉnh. Khi xuất khẩu, thương nhân chỉ cần kê khai với cơ quan Hải quan đầy đủ số lượng, chủng loại, không phải xuất trình nguồn gốc gỗ và không phải xin phép.

    Sản phẩm đồ mộc hoàn chỉnh (bao gồm cả đồ gỗ mỹ nghệ, đồ gỗ cao cấp) là các sản phẩm gỗ được lắp ráp hoàn chỉnh theo công dụng của loại sản phẩm hoặc các chi tiết tháo rời của sản phẩm hoàn chỉnh, khi lắp ráp có thể sử dụng được ngay theo công dụng của sản phẩm đó; được sản xuất bằng phương pháp thủ công hoặc máy, hoặc thủ công kết hợp máy; được hoàn thiện bằng các công nghệ bào, đục, chạm, trổ, khắc, khảm, tiện, trang trí bề mặt (sơn mài, mạ kim loại màu, phủ sơn bề mặt).

    b. Sản phẩm làm từ gỗ quy định tại Phụ lục II của Công ước CITES, khi xuất khẩu phải có giấy phép CITES do Cơ quan thẩm quyền quản lý CITES Việt Nam cấp.

    3. Được xuất khẩu các loại củi, than có nguồn gốc hợp pháp từ gỗ rừng tự nhiên trong nước. Khi xuất khẩu thương nhân chỉ cần kê khai với cơ quan Hải quan đầy đủ số lượng, chủng loại, không cần phải xuất trình nguồn gốc.

    Điều 4. Xuất khẩu, nhập khẩu động vật, thực vật (trừ gỗ và sản phẩm gỗ quy định tại Khoản 1 Điều 3) hoang dã nguy cấp, quý, hiếm

    1. Cấm xuất khẩu vì mục đích thương mại động vật, thực vật hoang dã nguy cấp, quý, hiếm khai thác từ rừng tự nhiên (trừ những trường hợp qui định tại khoản 2 Điều này):

    a. Động vật rừng nguy cấp, quý, hiếm thuộc nhóm IB và IIB, thực vật rừng thuộc nhóm IA tại Nghị định số 32/2006/NĐ-CP ngày 30 tháng 03 năm 2006 của Chính phủ về quản lý thực vật rừng, động vật rừng nguy cấp, quý, hiếm.

    b. Động vật, thực vật hoang dã quy định tại Phụ lục I của Công ước CITES;

    2. Xuất khẩu động vật, thực vật hoang dã nguy cấp, quý, hiếm phải có giấy phép của Cơ quan quản lý CITES Việt Nam thuộc các trường hợp sau­­:

    a. Xuất khẩu không vì mục đích thương mại:

    Động vật, thực vật hoang dã nguy cấp, quý, hiếm được quy định tại khoản 1 Điều này được xuất khẩu phục vụ ngoại giao, nghiên cứu khoa học, trao đổi giữa các vườn động vật, vườn thực vật, triển lãm, biểu diễn xiếc, trao đổi, trao trả mẫu vật giữa các Cơ quan thẩm quyền quản lý CITES các nước.

    b. Xuất khẩu vì mục đích thương mại:

    - Động vật, thực vật hoang dã, nguy cấp, quý, hiếm từ tự nhiên quy định tại Phục lục II của Công ước CITES.

    - Thực vật rừng từ tự nhiên thuộc nhóm IIA, quy định tại Nghị định số 32/2006/NĐ-CP ngày 30/3/2006 của Chính phủ về quản lý thực vật rừng, động vật rừng nguy cấp, quý, hiếm.

    - Động vật, thực vật hoang dã nguy cấp, quý, hiếm thuộc nhóm I, nhóm II của Nghị định số 32/2006/NĐ-CP ngày 30/3/2006 của Chính phủ và động vật, thực vật hoang dã quy định tại các Phụ lục I và II của Công ước CITES có nguồn gốc nuôi sinh sản, trồng cấy nhân tạo đảm bảo các điều kiện theo quy định tại Nghị định số 82/2006/NĐ-CP ngày 10/8/2006 của Chính phủ về quản lý hoạt động xuất khẩu, nhập khẩu, tái xuất khẩu, nhập nội từ biển, quá cảnh, nuôi sinh sản, nuôi sinh trưởng và trồng cấy nhân tạo các loài động vật, thực vật hoang dã nguy cấp, quý, hiếm.

    3. Nhập khẩu động vật, thực vật hoang dã quy định tại các Phụ lục của Công ước CITES phải được Cơ quan quản lý CITES Việt Nam cấp giấy phép.

    Điều 5. Xuất khẩu, nhập khẩu giống cây trồng

    1. Xuất khẩu giống cây trồng:

    a. Cấm xuất khẩu các loại giống cây trồng quý hiếm nằm trong Danh mục giống cây trồng quý hiếm cấm xuất khẩu tại các quyết định do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành.

    b. Đối với các loại giống cây trồng khác không thuộc Danh mục giống cây trồng quý hiếm cấm xuất khẩu nêu trên, khi xuất khẩu, thương nhân chỉ phải làm thủ tục tại Cơ quan Hải quan.

    2. Nhập khẩu giống cây trồng:

    a. Đối với giống cây trồng có tên trong Danh mục giống cây trồng được phép sản xuất, kinh doanh tại các quyết định do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành, khi nhập khẩu, thương nhân chỉ phải làm thủ tục với cơ quan Hải quan, không cần xin phép.

    b. Các loại giống cây trồng ngoài Danh mục trên, khi nhập khẩu để nghiên cứu, khảo nghiệm, sản xuất thử hoặc các trường hợp đặc biệt khác phải được Cục Trồng trọt (đối với giống cây nông nghiệp) và Cục Lâm nghiệp (đối với giống cây lâm nghiệp) thuộc Bộ Nông nghiệp và Phát triển nông thôn cấp phép. Căn cứ vào kết quả khảo nghiệm, sản xuất thử, Bộ Nông nghiệp và Phát triển nông thôn sẽ công nhận giống mới, sau đó bổ sung vào Danh mục giống cây trồng được phép sản xuất, kinh doanh.

    Sau khi có kết quả khảo nghiệm và được Cục Trồng trọt và Cục Lâm nghiệp có văn bản xác nhận là giống cây trồng đã khảo nghiệm và được phép sản xuất, kinh doanh, thương nhân được phép nhập khẩu mặt hàng này trong thời gian chờ để bổ sung vào Danh mục giống cây trồng được phép sản xuất, kinh doanh, không cần xin phép.

    Điều 6. Xuất khẩu, nhập khẩu giống vật nuôi

    1. Xuất khẩu giống vật nuôi:

    a. Cấm xuất khẩu các loại giống vật nuôi quý hiếm nằm trong Danh mục giống vật nuôi qúy hiếm cấm xuất khẩu do Bộ Nông nghiệp và Phát triển nông thôn ban hành.

    b. Đối với các loại giống vật nuôi khác ngoài Danh mục giống vật nuôi quý hiếm cấm xuất khẩu, khi xuất khẩu, thương nhân chỉ phải làm thủ tục tại Cơ quan Hải quan và xuất trình giấy chứng nhận kiểm dịch động vật nếu nước nhập khẩu hoặc chủ hàng có yêu cầu.

    2. Nhập khẩu giống vật nuôi:

    a. Đối với giống vật nuôi có tên trong Danh mục giống vật nuôi được phép sản xuất, kinh doanh tại các quyết định do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành, khi nhập khẩu, thương nhân chỉ phải làm thủ tục với cơ quan Hải quan, không cần xin phép.

    b. Các loại giống vật nuôi ngoài Danh mục trên, khi nhập khẩu phải được Cục Chăn nuôi thuộc Bộ Nông nghiệp và Phát triển nông thôn cấp giấy phép khảo nghiệm.

    Sau khi có kết quả khảo nghiệm và được Cục Chăn nuôi có văn bản xác nhận là giống vật nuôi đã khảo nghiệm và được phép sản xuất, kinh doanh, thương nhân được phép nhập khẩu mặt hàng này trong thời gian chờ để bổ sung vào Danh mục giống vật nuôi được phép sản xuất, kinh doanh, không cần xin phép.

    Căn cứ vào kết quả khảo nghiệm, Bộ Nông nghiệp và Phát triển nông thôn sẽ bổ sung vào Danh mục giống vật nuôi được được phép sản xuất, kinh doanh.

    c. Nhập khẩu phôi, tinh dịch gia súc, môi trường pha chế tinh, trứng giống gia súc và trứng giống gia cầm phải có giấy phép của Cục Chăn nuôi thuộc Bộ Nông nghiệp và Phát triển nông thôn.

    Điều 7. Nhập khẩu thuốc thú y, nguyên liệu làm thuốc thú y, vắc xin, chế phẩm sinh học, vi sinh vật, hoá chất dùng trong thú y

    1. Đối với các loại thuốc thú y, nguyên liệu làm thuốc thú y, chế phẩm sinh học, hoá chất dùng trong thú y có tên trong Danh mục thuốc thú y, nguyên liệu làm thuốc thú y được phép lưu hành tại Việt Nam tại các quyết định do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành, khi nhập khẩu thương nhân chỉ phải làm thủ tục tại cơ quan Hải quan, không cần xin phép. Riêng đối với các loại vắc xin và vi sinh vật phải có ý kiến đồng ý bằng văn bản của Cục Thú y thuộc Bộ Nông nghiệp và Phát triển nông thôn.

    2. Đối với nhập khẩu các loại thuốc thú y, nguyên liệu làm thuốc thú y, chế phẩm sinh học, vi sinh vật, hoá chất dùng trong thú y ngoài Danh mục được phép lưu hành tại Việt Nam, khi nhập khẩu để khảo nghiệm phải có ý kiến đồng ý bằng văn bản của Cục Thú y.

    Sau khi có kết quả khảo nghiệm và được Cục Thú y có văn bản xác nhận là thuốc thú y, nguyên liệu làm thuốc thú y, chế phẩm sinh học, vi sinh vật, hoá chất dùng trong thú y đã khảo nghiệm có chất lượng phù hợp với các qui định của Bộ Nông nghiệp và Phát triển nông thôn, thương nhân được phép nhập khẩu mặt hàng này trong thời gian chờ để bổ sung vào Danh mục thuốc thú y, nguyên liệu làm thuốc thú y, chế phẩm sinh học, vi sinh vật, hoá chất dùng trong thú y được phép lưu hành tại Việt Nam, không cần xin phép.

    Căn cứ vào kết quả khảo nghiệm, Bộ Nông nghiệp và Phát triển nông thôn sẽ bổ sung vào Danh mục thuốc thú y, nguyên liệu làm thuốc thú y, chế phẩm sinh học, vi sinh vật, hoá chất dùng trong thú y được phép lưu hành tại Việt Nam.

    3. Nhập khẩu thuốc và vắc xin thú y trong trường hợp có dịch bệnh khẩn cấp:

    Khi có dịch bệnh khẩn cấp, việc nhập khẩu thuốc và vắc xin thú y chưa có trong Danh mục thuốc và vắc xin thú y được phép lưu hành tại Việt Nam do Bộ Nông nghiệp và Phát triển nông thôn quyết định.

    Điều 8. Nhập khẩu thuốc BVTV, nguyên liệu thuốc BVTV và sinh vật sống trong lĩnh vực BVTV

    1. Đối với các loại thuốc BVTV và nguyên liệu thuốc BVTV trong Danh mục thuốc BVTV được phép sử dụng tại Việt Nam tại các quyết định do Bộ trưởng Nông nghiệp và Phát triển nông thôn ban hành, khi nhập khẩu, thương nhân chỉ phải làm thủ tục tại cơ quan Hải quan, không cần xin phép.

    2. Đối với các loại thuốc BVTV và nguyên liệu thuốc BVTV trong Danh mục thuốc BVTV hạn chế sử dụng tại Việt Nam tại các quyết định do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành, khi nhập khẩu phải có giấy phép của Cục Bảo vệ thực vật thuộc Bộ Nông nghiệp và Phát triển nông thôn.

    3. Đối với các loại thuốc BVTV và nguyên liệu thuốc BVTV ngoài Danh mục thuốc BVTV được phép sử dụng tại Việt Nam, khi nhập khẩu phải có giấy phép của Bộ Nông nghiệp và Phát triển nông thôn do Cục Bảo vệ thực vật cấp.

    Sau khi có kết quả khảo nghiệm và được Cục Bảo vệ thực vật có văn bản xác nhận là thuốc BVTV và nguyên liệu thuốc BVTV đã khảo nghiệm có chất lượng phù hợp với các qui định của Bộ Nông nghiệp và Phát triển nông thôn, thương nhân được phép nhập khẩu mặt hàng này trong thời gian chờ để bổ sung vào Danh mục thuốc BVTV được phép sử dụng tại Việt Nam, không cần xin phép.

    4. Cấm nhập khẩu các loại thuốc và nguyên liệu sản xuất thuốc bảo vệ thực vật trong Danh mục thuốc bảo vệ thực vật cấm sử dụng tại Việt Nam tại các quyết định do Bộ Nông nghiệp và Phát triển nông thôn ban hành. Trong một số trường hợp có thể được phép nhập khẩu chất chuẩn thuốc bảo vệ thực vật trong danh mục thuốc bảo vệ thực vật cấm sử dụng để phục vụ cho công tác kiểm tra dư lượng và thuốc bảo vệ thực vật nhập lậu nhưng phải có giấy phép của Cục Bảo vệ thực vật cấp.

    5. Đối với các loại sinh vật sống trong lĩnh vực Bảo vệ thực vật nhập khẩu lần đầu để thử nghiệm thực hiện theo Quyết định số 34/2007/QĐ-BNN ngày 23 tháng 4 năm 2007 về việc công bố danh mục vật thể thuộc diện kiểm dịch thực vật phải phân tích nguy cơ dịch hại trước khi nhập khẩu vào Việt Nam, Quyết định số 48/2007/QĐ-BNN ngày 29 tháng 5 năm 2007 ban hành Quy định về thủ tục cấp giấy phép kiểm dịch thực vật nhập khẩu đối với các vật thể phải phân tích nguy cơ dịch hại trước khi nhập khẩu vào Việt Nam.

    6. Thương nhân nhập khẩu thuốc thành phẩm, nguyên liệu thuốc bảo vệ thực vật ngoài Danh mục được phép sử dụng để gia công, đóng gói tại Việt Nam nhằm mục đích tái xuất theo hợp đồng đã ký với nước ngoài phải có giấy phép nhập khẩu của Cục Bảo vệ thực vật thuộc Bộ Nông nghiệp và Phát triển nông thôn và phải chịu sự kiểm tra việc tái xuất đó của các cơ quan nhà nước có thẩm quyền.

    Điều 9. Nhập khẩu thức ăn chăn nuôi và nguyên liệu sản xuất thức ăn chăn nuôi

    1. Các loại TACN, nguyên liệu sản xuất TACN có tên trong Danh mục TACN, nguyên liệu TACN được nhập khẩu vào Việt Nam tại các quyết định do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành, khi nhập khẩu, thương nhân chỉ phải làm thủ tục với cơ quan Hải quan, không cần xin phép.

    2. Đối với các loại TACN, nguyên liệu TACN, ngoài Danh mục nêu tại khoản 1 Điều này, khi nhập khẩu để phân tích, khảo nghiệm phải có giấy phép của Cục Chăn nuôi. Sau khi có kết quả khảo nghiệm và được Cục Chăn nuôi có văn bản xác nhận là mặt hàng TACN, nguyên liệu TACN đã khảo nghiệm có chất lượng phù hợp với các qui định của Bộ Nông nghiệp và Phát triển nông thôn, thương nhân được phép nhập khẩu mặt hàng này trong thời gian chờ để bổ sung vào Danh mục TACN, nguyên liệu TACN được nhập khẩu vào Việt Nam, không cần xin phép.

    Căn cứ kết quả phân tích, khảo nghiệm, Cục Chăn nuôi sẽ trình Bộ quyết định bổ sung vào Danh mục TACN, nguyên liệu TACN được nhập khẩu vào Việt Nam.

    3. Thương nhân nhập khẩu TACN, nguyên liệu TACN ngoài Danh mục TACN, nguyên liệu TACN được nhập khẩu vào Việt Nam để sản xuất, gia công, san bao đóng gói tại Việt Nam nhằm mục đích tái xuất theo hợp đồng đã đăng ký với nước ngoài phải có giấy phép của Bộ Nông nghiệp và Phát triển nông thôn do Cục Chăn nuôi cấp và chịu sự kiểm tra việc tái xuất đó của các cơ quan có thẩm quyền.

    Điều 10. Nhập khẩu phân bón

    1. Đối với các loại phân bón có trong Danh mục phân bón được phép sản xuất, kinh doanh và sử dụng tại Việt Nam tại các quyết định do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành, khi nhập khẩu, thương nhân chỉ phải làm thủ tục tại Cơ quan Hải quan.

    2. Những loại phân bón ngoài các Danh mục nêu trên, khi nhập khẩu để nghiên cứu, khảo nghiệm hoặc các trường hợp đặc biệt khác phải được Cục Trồng trọt thuộc Bộ Nông nghiệp và Phát triển nông thôn cho phép. Sau khi có kết quả khảo nghiệm và được Cục Trồng trọt có văn bản xác nhận là mặt hàng phân bón đã khảo nghiệm có chất lượng phù hợp với các qui định của Bộ Nông nghiệp và Phát triển nông thôn, thương nhân được phép nhập khẩu mặt hàng này trong thời gian chờ để bổ sung vào Danh mục phân bón được phép sản xuất, kinh doanh và sử dụng tại Việt Nam, không cần xin phép.

    Căn cứ vào kết quả khảo nghiệm, Bộ Nông nghiệp và Phát triển nông thôn sẽ công nhận phân bón mới và bổ sung vào Danh mục phân bón được phép sản xuất, kinh doanh và sử dụng tại Việt Nam.

    Điều 11. Xuất khẩu, nhập khẩu nguồn gen cây trồng, vật nuôi, vi sinh vật phục vụ nghiên cứu, trao đổi khoa học, kỹ thuật

    Tất cả vật thể là nguồn gen cây trồng quý hiếm, vật nuôi, vi sinh vật, chế phẩm sinh học mới dùng trong nông nghiệp phục vụ cho mục đích nghiên cứu, thử nghiệm, trao đổi khoa học kỹ thuật, khi xuất khẩu, nhập khẩu phải được Bộ Nông nghiệp và Phát triển nông thôn cho phép.

    Điều 12. Xuất khẩu, nhập khẩu hàng hóa chuyên ngành thủy sản

    1. Xuất khẩu các loài thủy sản nguy cấp, quý, hiếm:

    a. Cấm xuất khẩu các loài thủy sản có tên trong Danh mục tại Phụ lục 1 kèm theo Thông tư này (trừ trường hợp qui định tại điểm b khoản này).

    b. Các loài thuỷ sản có tên trong Danh mục tại Phụ lục 1 chỉ được xuất khẩu trong một số trường hợp để thực hiện Điều ước quốc tế mà Việt Nam đã ký kết hoặc gia nhập. Khi xuất khẩu phải được Văn phòng CITES Việt Nam cấp giấy phép đối với loài thủy sản thuộc phụ lục của Công ước CITES hoặc Cục Khai thác và Bảo vệ nguồn lợi thủy sản cấp phép đối với các loài thủy sản không thuộc phụ lục của Công ước CITES.

    c. Các loài thủy sản thuộc Phụ lục 2 kèm theo Thông tư này chỉ được xuất khẩu khi đáp ứng đủ các điều kiện nêu tại Phụ lục 2. Thương nhân trực tiếp làm thủ tục xuất khẩu với cơ quan Hải quan, không cần xin phép.

    2. Nhập khẩu giống thủy sản:

    - Đối với giống thủy sản có tên trong Danh mục giống thủy sản được phép sản xuất, kinh doanh tại các quyết định do Bộ trưởng Nông nghiệp và Phát triển nông thôn hoặc các quyết định của Bộ trưởng Bộ Thủy sản (cũ) ban hành, khi nhập khẩu, thương nhân chỉ phải làm thủ tục với cơ quan Hải quan, không cần xin phép.

    - Các loại giống thủy sản ngoài Danh mục trên, chỉ được nhập khẩu để khảo nghiệm và phải được Cục Nuôi trồng thủy sản thuộc Bộ Nông nghiệp và Phát triển nông thôn cấp giấy phép.

    Sau khi có kết quả khảo nghiệm và được Cục Nuôi trồng thủy sản có văn bản xác nhận là giống thủy sản đã khảo nghiệm có chất lượng phù hợp với các qui định của Bộ Nông nghiệp và Phát triển nông thôn, thương nhân được phép nhập khẩu mặt hàng này trong thời gian chờ để bổ sung vào Danh mục giống thủy sản được phép sản xuất, kinh doanh, không cần xin phép.

    Căn cứ vào kết quả khảo nghiệm, Bộ Nông nghiệp và Phát triển nông thôn sẽ bổ sung vào Danh mục giống thủy sản được được phép sản xuất, kinh doanh.

    3. Nhập khẩu thức ăn thủy sản:

    Thức ăn thủy sản, nguyên liệu sản xuất thức ăn thủy sản đáp ứng đủ các điều kiện nêu tại Phụ lục 3 kèm theo Thông tư này, thương nhân trực tiếp làm thủ tục nhập khẩu với Hải quan cửa khẩu, không cần xin phép.

    4. Nhập khẩu thuốc thú y thủy sản vắc xin, chế phẩm sinh học, vi sinh vật, hoá chất dùng trong thú y thủy sản và hóa chất dùng trong nuôi trồng thủy sản:

    a. Đối với các loại thuốc thú y thủy sản chế phẩm sinh học, hoá chất dùng trong thú y thủy sản có tên trong Danh mục được phép lưu hành tại Việt Nam tại các quyết định do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành, khi nhập khẩu thương nhân chỉ phải làm thủ tục tại cơ quan Hải quan, không cần xin phép.

    Đối với các loại vắc xin và vi sinh vật khi nhập khẩu phải có ý kiến của Cục Thú y thuộc Bộ Nông nghiệp và Phát triển nông thôn.

    Đối với các loại hoá chất dùng trong nuôi trồng thủy sản, nguyên liệu sản xuất thuốc thú y thủy sản trong Danh mục tại Phụ lục 4 kèm theo Thông tư này, nếu đáp ứng đủ các điều kiện nêu tại Phụ lục 4, thương nhân trực tiếp làm thủ tục nhập khẩu với Hải quan cửa khẩu, không cần phải xin phép.

    b. Đối với các loại thuốc thú y thủy sản, chế phẩm sinh học, vi sinh vật, hoá chất dùng trong thú y thủy sản và hóa chất dùng trong nuôi trồng thủy sản ngoài Danh mục được phép lưu hành tại Việt Nam, khi nhập khẩu phải có giấy phép của Cục Thú y.

    c. Đối với thuốc thú y thủy sản chế phẩm sinh học, hoá chất dùng trong thú y thủy sản và hóa chất dùng trong nuôi trồng thủy sản nhập khẩu để khảo nghiệm, sau khi có kết quả khảo nghiệm và được Cục Thú y có văn bản xác nhận là mặt hàng đã khảo nghiệm có chất lượng phù hợp với các qui định của Bộ Nông nghiệp và Phát triển nông thôn, thương nhân được phép nhập khẩu mặt hàng này trong thời gian chờ để bổ sung vào Danh mục thuốc thú y thủy sản, nguyên liệu làm thuốc thú y thủy sản, chế phẩm sinh học, hoá chất dùng trong thú y thủy sản và hóa chất dùng trong nuôi trồng thủy sản được phép lưu hành tại Việt Nam, không cần xin phép.

    Căn cứ vào kết quả khảo nghiệm, Bộ Nông nghiệp và Phát triển nông thôn sẽ bổ sung vào Danh mục thuốc thú y thủy sản, nguyên liệu làm thuốc thú y thủy sản, chế phẩm sinh học, hoá chất dùng trong thú y thủy sản và hóa chất dùng trong nuôi trồng thủy sản được phép lưu hành tại Việt Nam.

    5. Nhập khẩu chế phẩm sinh học, vi sinh vật và enzyme dùng trong xử lý, cải tạo môi trường nuôi trồng thuỷ sản:

    a. Đối với chế phẩm sinh học, vi sinh vật và enzyme dùng trong xử lý, cải tạo môi trường nuôi trồng thuỷ sản có tên trong Danh mục được phép lưu hành tại Việt Nam do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn/Bộ Thủy sản (cũ) ban hành, khi nhập khẩu thương nhân trực tiếp làm thủ tục thông quan tại cơ quan Hải quan, không cần xin phép.

    b. Đối với chế phẩm sinh học, vi sinh vật và enzyme dùng trong xử lý, cải tạo môi trường nuôi trồng thuỷ sản có tên trong Phụ lục 4, Phụ lục 5 kẻm theo Thông tư này và Danh mục nhập khẩu có điều kiện do Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn/Bộ Thủy sản (cũ) ban hành, khi đáp ứng các điều kiện qui định tại các phụ lục này Thương nhân trực tiếp làm thủ tục thông quan tại cơ quan Hải quan, không cần xin phép.

    c. Đối với chế phẩm sinh học, vi sinh vật và enzyme dùng trong xử lý, cải tạo môi trường nuôi trồng thuỷ sản ngoài Danh mục được phép lưu hành tại Việt Nam và Danh mục nhập khẩu có điều kiện tại Phụ lục 4 và Phụ lục 5 kèm theo Thông tư này, khi nhập khẩu phải có giấy phép nhập khẩu của Cục Nuôi trồng thủy sản.

    d. Đối với chế phẩm sinh học, vi sinh vật và enzyme dùng trong xử lý, cải tạo môi trường nuôi trồng thuỷ sản nhập khẩu để khảo nghiệm, sau khi có kết quả khảo nghiệm và được Cục Nuôi trồng thủy sản có văn bản xác nhận là sản phẩm đã khảo nghiệm có chất lượng phù hợp với các qui định của Bộ Nông nghiệp và Phát triển nông thôn, thương nhân được phép nhập khẩu mặt hàng này trong thời gian chờ để bổ sung vào Danh mục chế phẩm sinh học, vi sinh vật và enzyme dùng trong xử lý, cải tạo môi trường nuôi trồng thuỷ sản được phép lưu hành tại Việt Nam, không cần xin phép.

    Căn cứ vào kết quả khảo nghiệm, Bộ Nông nghiệp và Phát triển nông thôn sẽ công nhận chế phẩm sinh học, vi sinh vật và enzyme dùng trong xử lý, cải tạo môi trường nuôi trồng thuỷ sản mới và bổ sung vào Danh mục chế phẩm sinh học, vi sinh vật và enzyme dùng trong xử lý, cải tạo môi trường nuôi trồng thuỷ sản được phép lưu hành tại Việt Nam.

    Chương III

    ĐIỀU KHOẢN THI HÀNH

    Điều 13. Tổ chức thực hiện

    1. Cơ quan quản lý chuyên ngành được Bộ Nông nghiệp và Phát triển nông thôn giao nhiệm vụ tiếp nhận và giải quyết hồ sơ, cấp giấy phép xuất khẩu, nhập khẩu và giấy phép khảo nghiệm theo các địa chỉ sau:

    a. Cục Lâm nghiệp (Số 2 Ngọc Hà- Quận Ba Đình-Hà Nội): Các trường hợp thuộc Điều 3 (trừ điểm b khoản 2) của Chương II.

    b. Cục Kiểm lâm (Số 2 Ngọc Hà- Quận Ba Đình-Hà Nội): Các trường hợp thuộc điểm b khoản 2 Điều 3 và Điều 4 Chương II.

    c. Cục Trồng trọt, (Số 2 Ngọc Hà- Quận Ba Đình-Hà Nội): Các trường hợp thuộc Điều 5, Điều 10 và Điều 11 Chương II.

    d. Cục Chăn nuôi (Số 2 Ngọc Hà- Quận Ba Đình-Hà Nội): Các trường hợp thuộc Điều 6 và Điều 9 Chương II.

    đ. Cục Thú y (Số 15 ngõ 78 đường Giải Phóng-Phường Phương Mai, Quận Đống Đa, Hà Nội): Các trường hợp thuộc Điều 7, điểm a, điểm b và điểm c của khoản 4 Điều 12 Chương II.

    e. Cục Bảo vệ thực vật (149 Hồ Đắc Di-Quận Đống Đa-Hà Nội): Các trường hợp thuộc Điều 8 Chương II.

    g. Cục Nuôi trồng thủy sản (số 10 Nguyễn Công Hoan -Ba Đình -Hà Nội): Các trường hợp thuộc khoản 2, điểm b và điểm c khoản 5 Điều 12 Chương II.

    h. Cục Khai thác và Bảo vệ nguồn lợi thủy sản (số 10 Nguyễn Công Hoan, Ba Đình, Hà Nội): Các trường hợp thuộc điểm b khoản 1 Điều 12 Chương II.

    2. Mẫu hồ sơ, thủ tục xin cấp phép nhập khẩu: Theo mẫu hồ sơ và thủ tục xin cấp phép nhập khẩu do các cơ quan quản lý chuyên ngành của Bộ Nông nghiệp và Phát triển nông thôn ban hành.

    3. Thời hạn giải quyết hồ sơ: trong thời gian 07 ngày làm việc kể từ ngày nhận được hồ sơ hợp lệ, các cơ quan tiếp nhận hồ sơ quy định tại (khoản 1 Điều 13) Mục 1 Chương này phải có văn bản trả lời.

    4. Các cơ quan quản lý chuyên ngành của Bộ Nông nghiệp và Phát triển nông thôn theo Khoản 1 Điều 13 Chương III có trách nhiệm hướng dẫn hồ sơ, thủ tục xin cấp phép xuất, nhập khẩu và phối hợp với Tổng cục Hải quan để áp mã số HS đối với hàng hóa chuyên ngành nông nghiệp, thủy sản được phân công tại Thông tư này.

    5. Khi ban hành mới, sửa đổi hoặc bổ sung các Danh mục hàng hoá thuộc diện quản lý chuyên ngành nông nghiệp được quy định tại Thông tư này, các Cục được Bộ Nông nghiệp và Phát triển nông thôn giao nhiệm vụ quản lý chuyên ngành có trách nhiệm thông báo cho Hải quan và các cơ quan liên quan.

    6. Thương nhân chịu trách nhiệm trước pháp luật về tính chính xác của nội dung khai báo khi xuất khẩu, nhập khẩu và thực hiện các quy định hiện hành của nhà nước về tiêu chuẩn chất lượng hàng hoá.

    Điều 14. Hiệu lực thi hành

    1. Thông tư này có hiệu lực sau 45 ngày kể từ ngày ký.

    2. Thông tư này thay thế các văn bản sau:

    - Thông tư 32/2006/TT-BNN ngày 08/5/2006 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn việc thực hiện Nghị định số 12/2006/NĐ-CP ngày 23/01/2006 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hoá quốc tế và các đại lý, mua, bán, gia công và quá cảnh hàng hoá với nước ngoài.

    - Thông tư 101/2007/TT-BNN ngày 10/12/2007 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn sửa đổi, bổ sung một số nội dung của Thông tư 32/2006/TT-BNN ngày 08/5/2006 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn việc thực hiện Nghị định số 12/2006/NĐ-CP ngày 23/01/2006 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hoá quốc tế và các đại lý, mua, bán, gia công và quá cảnh hàng hoá với nước ngoài.

    - Thông tư số 40/2008/TT-BNN ngày 03/3/2008 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn sửa đổi, bổ sung Thông tư 101/2007/TT-BNN ngày 10 tháng 12 năm 2007 của Bộ NN&PTNT về việc sửa đổi, bổ sung một số nội dung của Thông tư số 32/2006/TT-BNN ngày 08 tháng 5 năm 2006 của Bộ NN&PTNT “Hướng dẫn thực hiện Nghị định số 12/2006/NĐ-CP ngày 23 tháng 01 năm 2006 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hoá quốc tế và các đại lý, mua, bán, gia công và quá cảnh hàng hoá với nước ngoài”.

    - Quyết định số 15/2006/QĐ-BTS ngày 08/9/2006 của Bộ trưởng Bộ Thủy sản ban hành Quy chế quản lý nhập khẩu, xuất khẩu hàng hóa chuyên ngành thủy sản.

    Trong quá trình thực hiện, nếu có khó khăn, vướng mắc đề nghị các cơ quan, tổ chức, cá nhân phản ánh về Bộ Nông nghiệp và Phát triển nông thôn để kịp thời sửa đổi, bổ sung./.

    Tất cả các mặt hàng nằm trong Danh mục này khi nhập khẩu phải đáp ứng đủ các điều kiện sau:

    - Bản gốc hoặc bản sao hợp pháp giấy phép của cơ quan thẩm quyền nước sản xuất cho phép sản xuất, lưu hành (chỉ áp dụng đối với hàng hóa nêu tại mục B).

    CIRCULAR

    GUIDING THE GOVERNMENT'S DECREE NO. 12/2006/ND-CP OF JANUARY 23, 2006, DETAILING THE COMMERCIAL LAW'S PROVISIONS ON INTERNATIONAL GOODS TRADING AND GOODS TRADING, PROCESSING AND TRANSIT AGENCY WITH FOREIGN COUNTRIES IN THE DOMAINS OF AGRICULTURE, FORESTRY AND FISHERIES

    THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

    Pursuant to the Government's Decree No. 01/2008/ND-CP of January 3, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
    Pursuant to the Government's Decree No. 12/2006/ND-CP of January 23, 2006, detailing the Commercial Law's provisions on international goods trading and goods trading, processing and transit agency with foreign countries;
    Pursuant to the Government's Decree No. 32/2006/ND-CP of March 30, 2006, on management of endangered, precious and rare forest plants and animals;
    Pursuant to the Government's Decree No. 82 2006/ND-CP of August 10, 2006, on management of export, import, re-export, introduction from the sea, transit, breeding, rearing and artificial propagation of endangered species of precious and rare wild fauna and flora;
    The Ministry of Agriculture and Rural Development guides the import and export of goods subject to specialized management by the agriculture sector as follows:

    Chapter I

    GENERAL PROVISIONS

    Article 1. Scope of regulation

    This Circular prescribes the order of and procedures for import and export of goods subject to specialized management by the agriculture, forestry and fisheries sectors, including:

    a/ Export of timber and timber products from domestic natural forests; firewood and charcoal from timber or firewood originating from domestic natural forests;

    b/ Import and export of endangered, precious and rare wild animals and plants;

    c/ Import and export of plant varieties;

    d/ Import and export of livestock breeds:

    e/ Import and export of live aquatic products and breeder aquatic species;

    f/ Import of veterinary drugs, and materials for veterinary drug production, vaccines, biologicals, microorganisms and chemicals to be used for animals and aquatic species;

    g/ Import of plant protection drugs, materials for production of these drugs, and living organisms in the plant protection domain;

    h/ Import of feeds and materials for production of feeds; aquatic feeds and materials for production of aquatic feeds;

    i/ Import of fertilizers and fertilizer preparations;

    j/ Import and export of gene sources of plants, domestic animals and microorganisms for scientific and technical research and exchange.

    Article 2. Principles for implementation of regulations on animal and plant quarantine and inspection of imported goods

    1. Before customs clearance, imports subject to animal, aquatic, animal product and aquatic product quarantine must comply with decisions of the Minister of Agriculture and Rural Development or the former Minister of Fisheries, promulgating the list of objects subject to animal, aquatic, animal product and aquatic product quarantine, the list of animals, the list of aquatic species, animal products and aquatic products subject to quarantine, and the order of and procedures for the quarantine of animals, aquatic species, animal products and aquatic products, and veterinary hygiene inspection.

    2. Before customs clearance, imports on the list of objects subject to plant quarantine must comply with the Ministry of Agriculture and Rural Development's decisions promulgating Vietnam's list of objects subject to plant quarantine, list of entities subject to plant quarantine, list of objects subject to plant quarantine and analysis of harmful epidemic danger before their importation into Vietnam, and the procedures for inspection of objects subject to plant quarantine and compilation of plant quarantine dossiers.

    3. When there exists no animal or plant quarantine agency at a border gate, goods will be cleared from customs procedures under the mechanism of registration first and inspection later. Quarantine agencies may conduct quarantine concurrently with customs inspection of goods or after the completion of customs procedures at a time and place indicated in quarantine registration papers.

    4. The quality of plant protection drugs and materials for the production of these drugs shall be inspected by the mode of registration before and quality inspection after customs clearance.

    Chapter II

    SPECIFIC PROVISIONS

    Article 3. Export of timber and timber products, firewood and charcoal from timber or firewood originating from domestic natural forests

    1. Timber and timber products from domestic natural forests banned from export (except the cases specified in Clauses 2 and 3 of this Article) include:

    a/ Log timber of all kinds;

    b/ Sawn timber of all kinds;

    c/ Products from endangered, precious and rare timber of group IA (except material evidence confiscated under the State's current regulations) specified in the Government's Decree No. 32/ 2006/ND-CP of March 30, 2006. on the management of endangered, precious and rare forest animals and plants; and timber products specified in Appendix I to the Convention on International Trade of Endangered Species of Wild Fauna and Flora (CITES).

    2. Timber products exported under specific conditions or permits

    a/ Products from endangered, precious and rare timber of group IA, which are material evidence confiscated under the State's current regulations, and of group IIA under the Government's Decree No. 32/2006/ND-CP of March 30, 2006, on management of endangered, precious and rare forest animals and plants, may only be exported in finished woodworks. Upon exportation of these products, traders shall only fully declare their quantities and categories with customs offices, without having to show the origin of timber and apply for permits.

    Finished woodworks (including also fine-art and high-class woodworks) are timber products, which are completely assembled according to their utilities, or knocked down details of finished products and can be used immediately after they are assembled according to utilities of these products; produced by hand, by machine or by hand in combination with machine; and finished by carving, embossing, engraving, inlaying or turning, and surface-decorated (by lacquering, gold plating or gloss painting).

    b/ When exporting timber products specified in Appendix II to CITES, CITES permits granted by the CITES Management Authority in Vietnam are required.

    3. Firewood and charcoal made from domestic natural forest timber of lawful origin may be exported. Upon exportation of these products, traders shall only fully declare their quantities and categories with customs offices without having to show their origin.

    Article 4. Import and export of endangered, precious and rare wild animals and plants (except timber and timber products specified in Clause 1, Article 3)

    1. Commercial export of the following endangered, precious and rare wild animals and plants from natural forests (except the cases specified in Clause 2 of this Article) is banned:

    a/ Endangered, precious and rare forest animals of groups IB and IIB, forest plants of group IA, specified in the Government's Decree No. 32/2006/ND-CP of March 30. 2006. on management of endangered, precious and rare forest animals and plants.

    b/ Wild animals and plants specified in Appendix I to the CITES.

    2. Export of endangered, precious and rare wild animals and plants requires permits of the CITES Management Authority in Vietnam in the following cases:

    a/ Non-commercial export:

    Endangered, precious and rare wild animals and plants specified in Clause 1 of this Article may be exported for diplomatic purpose, scientific research or exchange between zoological or botanical gardens, exhibition, circuit performance, and return of specimen between CITES Management Authorities of different countries.

    b/ Commercial export:

    Endangered, precious and rare wild animals and plants from natural forests specified in Appendix II to the CITES.

    - Natural forest plants of group IIA, specified in the Government's Decree No. 32/2006/ND-CP of March 30, 2006, on management of endangered, precious and rare forest plants and animals.

    - Endangered, precious and rare wild animals and plants of groups I and II, specified the Government's Decree No. 32/2006/ND-CP of March 30. 2006. and wild animals and plants specified in Appendices I and II to the CITES, artificially bred or cultured and satisfy the conditions specified in the Government's Decree No. 82/2006/ND-CP of August 10, 2006, on management of export, import, re-export, introduction from the sea, transit, breeding, rearing and artificial propagation of endangered species of precious and rare wild fauna and flora.

    3. Import of wild animals and plants specified in Appendices of the CITES must obtain permits in writing by the CITES Management Authority in Vietnam.

    Article 5. Import and export of plant varieties

    1. Export of plant varieties:

    a/ Precious and rare plant varieties on the list of precious and rare plant varieties banned from export promulgated together with decisions of the Minister of Agriculture and Rural Development is banned from export.

    b/ When exporting other plant varieties outside the above-said list, traders shall only carry out procedures at customs offices.

    2. Import of plant varieties:

    a/ When importing plant varieties on the list of plant varieties permitted for production and trading promulgated together with decisions of the Minister of Agriculture and Rural Development, traders shall only carry out procedures at customs offices without having to apply for permits.

    b/ Import of plant varieties outside the above-said list for research, assay, trial production or other special purposes must be permitted in writing by the Ministry of Agriculture and Rural Development's Cultivation Department (for agricultural plant varieties) or Forestry Department (for forest plant varieties). Based on assay or trial production results, the Ministry of Agriculture and Rural Development shall recognize new plant varieties and add them to the list of plant varieties permitted for production and trading.

    After obtaining assay results and written certification by the Cultivation Department and the Forestry Department that certain plant varieties have been assayed and permitted for production and trading, traders may import without permits these items pending the addition thereof to the list of plant varieties permitted for production and trading.

    Article 6. Import and export of livestock breeds

    1. Export of livestock breeds:

    a/ Precious and rare livestock species and breeds on the list of precious and rare livestock breeds banned from export promulgated by the Ministry of Agriculture and Rural Development is banned from export.

    b/ When exporting other livestock species and breeds outside the above-said list, traders shall only carry out procedures at customs offices and produce animal quarantine certificates, if so requested by countries of importation or goods owners.

    2. Import of livestock breeds:

    a/ When importing livestock breeds on the list of livestock breeds permitted for production and trading promulgated together with decisions of the Minister of Agriculture and Rural Development, traders shall only carry out procedures at customs offices without having to apply for permits.

    b/ Import of livestock species and breeds outside the above-said list requires assay permits granted by the Ministry of Agriculture and Rural Development's Cultivation Department.

    After obtaining assay results and written certification by the Cultivation Department that certain livestock breeds have been assayed and permitted for production and trading, traders may import without permits these items pending the addition thereof to the list of livestock breeds permitted for production and trading.

    Based on assay results, the Ministry of Agriculture and Rural Development shall add assayed livestock breeds to the list of livestock breeds permitted for production and trading.

    c/ Import of cattle embryos and sperm, cattle sperm- and egg-preparing solutions, and breeder poultry eggs must be permitted in writing by the Ministry of Agriculture and Rural Development's Husbandry Department.

    Article 7. Import of veterinary drugs and materials for production of veterinary drugs, vaccines, biologicals. microorganisms and chemicals for veterinary use

    1. When importing veterinary drugs and materials for production of veterinary drugs, biologicals and chemicals for veterinary use specified in the list of veterinary drugs and materials for the production of veterinary drugs permitted for circulation in Vietnam, promulgated together with decisions of the Minister of Agriculture and Rural Development, traders shall only carry out procedures at customs offices without having to apply for permits. Particularly for vaccines and microorganisms of all kinds, written approval of the Ministry of Agriculture and Rural Development's Animal Health Department is required.

    2. Import of veterinary drugs, materials for production of veterinary drugs, biologicals, microorganisms and chemicals for veterinary use outside the above-said list for assay purpose requires written approval of the Animal Health Department.

    After obtaining assay results and written certification by the Animal Health Department that assayed veterinary drugs, materials for production of veterinary drugs, biologicals. microorganisms and chemicals for veterinary use are up to the quality standards promulgated by the Ministry of Agriculture and Rural Development, traders may import without permits these items pending the addition thereof to the list of veterinary drugs, materials for production of veterinary drugs, biologicals. microorganisms and chemicals for veterinary use permitted for circulation in Vietnam.

    Based on assay results, the Ministry of Agriculture and Rural Development shall add assayed items to the above-said list.

    3. Import of veterinary drugs and vaccines in case of epidemics:

    When epidemics occur, the import of veterinary drugs and vaccines not yet on the list of veterinary drugs and vaccines permitted for circulation in Vietnam shall be decided by the Ministry of Agriculture and Rural Development.

    Article 8. Import of plant protection drugs, materials for production of plant protection drugs and living organisms in the plant protection domain

    1. When importing plant protection drugs and materials for production of plant protection drugs on the list of plant protection drugs permitted for use in Vietnam, promulgated together with decisions of the Minister of Agriculture and Rural Development, traders shall carry out procedures at customs offices without having to apply for permits.

    2. Import of plant protection drugs and materials for production of plant protection drugs on the list of plant protection drugs restricted from use in Vietnam, promulgated together with decisions of the Minister of Agriculture and Rural Development requires permits granted by the Ministry of Agriculture and Rural Development's Plant Protection Department.

    3. Import of plant protection drugs and materials for production of plant protection drugs outside the list of plant protection drugs permitted for use in Vietnam requires permits granted by the Ministry of Agriculture and Rural Development's Plant Protection Department.

    After obtaining assay results and written certification by the Plant Protection Department that assayed plant protection drugs and materials for production of plant protection are up to the quality standards promulgated by the Ministry of Agriculture and Rural Development, traders may import without permits these items pending the addition thereof to the list of plant protection drugs permitted for circulation in Vietnam.

    4. Import of plant protection drugs and materials for protection of plant protection drugs on the list of plant protection drugs banned from use in Vietnam, promulgated together with decisions of the Ministry of Agriculture and Rural Development, is banned. In some cases, standard ingredients of plant protection drugs on the list of plant protection drugs banned from use may be imported for inspection of drug residues and illegally imported plant protection drugs but with permits of the Plant Protection Department.

    5. First-time import of living organisms in the plant protection domain for assay purpose complies with Decision No. 34/2007/QD-BNN of April 23.2007, promulgating the list of objects subject to plant quarantine and compulsory analysis of latent epidemic hazards before their importation into Vietnam, and Decision No. 48/ 2007/QD-BNN of May 29. 2007, promulgating the Regulation on procedures for granting licenses for imported plant quarantine of objects subject to compulsory analysis of latent epidemic hazards before their importation into Vietnam.

    6. Importers of finished plant protection drugs and materials for production of plant protection drugs outside the list of plant protection drugs permitted for processing and packaging in Vietnam for re-export under contracts signed with foreign parties shall obtain import permits of the Ministry of Agriculture and Rural Development's Plant Protection Department and such re-export shall be inspected by competent state agencies.

    Article 9. Import of livestock feeds and their materials

    1. When importing livestock feeds and their materials on the list of livestock feeds and their materials permitted for import into Vietnam promulgated together with decisions of the Minister of Agriculture and Rural Development, traders shall only carry out procedures at customs offices without having to apply for permits.

    2. Import of livestock feeds and their materials outside the list specified in Clause 1 of this Article for analysis or assay requires permits of the Husbandry Department. After obtaining assay results and written certification by the Husbandry Department that assayed livestock feeds and their materials are up to the quality standards promulgated by the Ministry of Agriculture and Rural Development, traders may import without permits these items pending the addition thereof to the list of livestock feeds and their materials permitted for import into Vietnam.

    Based on assay or analysis results, the Husbandry Department shall propose the Ministry to decide to add assayed livestock feeds and their materials to the list of livestock feeds and their materials permitted for import into Vietnam.

    3. Importers of livestock feeds and their materials outside the above-said list for production, processing and packaging in Vietnam for re-export purpose under contracts signed with foreign parties shall obtain the Ministry of Agriculture and Rural Development's permits granted by the Husbandry Department and such re-export shall be inspected by competent agencies.

    Article 10. Import of fertilizers

    1. When importing fertilizers on the list of fertilizers permitted for production, trading and use in Vietnam, promulgated together with decisions of the Minister of Agriculture and Rural Development, traders shall only carry out procedures at customs offices.

    2. Import of fertilizers outside the above-said list for research or assay or other special purposes shall be permitted by the Ministry of Agriculture and Rural Development's Cultivation Department. After obtaining assay results and written certification by the Cultivation Department that assayed fertilizers are up to the quality standards promulgated by the Ministry of Agriculture and Rural Development, traders may import without permits these items pending the addition thereof to the list of fertilizers permitted for production, trading and use in Vietnam.

    Based on assay results, the Ministry of Agriculture and Rural Development shall recognize new fertilizers and add them to the list of fertilizers permitted for production, trading and use in Vietnam.

    Article 11. Import and export of gene sources of plants, domestic animals and microorganisms for scientific and technical research and exchange

    Import and export of all objects being gene sources of precious and rare plants, domestic animals, microorganisms and new biologicals for scientific and technical research and exchange must be permitted by the of Agriculture and Rural Development.

    Article 12. Import and export of fisheries goods

    1. Export of endangered, precious and rare aquatic species:

    a/ Export of aquatic species on the list in Appendix 1 to this Circular (except those specified at Point b of this Clause) is banned.

    b/ Aquatic species on the list in Appendix 1 may only be exported in some cases for implementation of treaties to which Vietnam has signed or acceded and with permits granted by the Vietnam-based CITES Office, for aquatic species specified in the Appendix to the CITES, or by the Aquatic Resource Exploitation and Protection Department, for aquatic species not specified in the Appendix to the CITES.

    c/ Aquatic species on the list in Appendix 2 to this Circular may only be exported when fully satisfying the conditions specified in Appendix 2. Traders shall directly carry out export procedures at customs offices without having to apply for permits.

    2. Import of aquatic breeds:

    - When importing aquatic breeds on the list of aquatic breeds permitted for production and trading, promulgated together with decisions of the Minister of Agriculture and Rural Development or decisions of the (former) Minister of Fisheries, traders shall only carry out procedures at customs offices without having to apply for permits.

    - Aquatic breeds outside the above-said list may only be imported for assay with permits of the Ministry of Agriculture and Rural Development's Aquaculture Department.

    After obtaining assay results and written certification by the Aquaculture Department that assayed aquatic breeds are up to quality standards promulgated by the Ministry of Agriculture and Rural Development, traders may import without permits these items pending the addition thereof to the list of aquatic breeds permitted for production and trading.

    Based on assay results, the Ministry of Agriculture and Rural Development shall add assayed aquatic breeds to the list of aquatic breeds permitted for production and trading.

    3 Import of aquatic feeds:

    For import of aquatic feeds and their production materials which fully satisfy the conditions specified in Appendix 3 to this Circular, traders shall directly carry out import procedures at border-gate customs offices without having to apply for permits.

    4. Import of aquatic veterinary drugs, vaccines, biologicals, microorganisms and chemicals for use in aquatic animal health protection and chemicals for use in aquaculture:

    a/ When importing aquatic veterinary drugs, biologicals and chemicals for use in aquatic animal health protection on the list of those permitted for circulation in Vietnam, promulgated together with decisions of the Minister of Agriculture and Rural Development, traders shall only carry out procedures at customs offices without having to apply for permits.

    Import of vaccines and microorganisms requires opinions of the Ministry of Agriculture and Rural Development's Animal Health Department.

    For chemicals for use in aquaculture and materials for production of aquatic veterinary drugs on the list in Appendix 4 to this Circular, which fully satisfy the conditions specified in this Appendix, traders shall directly carry out import procedures at border-gate customs offices without having to apply for permits.

    b/ Import of aquatic veterinary drugs, biologicals, microorganisms and chemicals for use in aquatic animal health protection and chemical for use in aquaculture outside the list of those permitted for circulation in Vietnam requires permits of the Animal Health Department.

    c/ For aquatic veterinary drugs, biologicals and chemicals for use in aquatic animal health protection and chemical for use in aquaculture imported for assay, after obtaining assay results and written certification by the Animal Health Department that assayed items are up to the quality standards promulgated by the Ministry of Agriculture and Rural Development, traders may import without permits these items pending the addition thereof to the list of aquatic veterinary drugs and their production materials, biologicals and chemicals for use in aquatic animal health protection and chemical for use in aquaculture permitted for circulation in Vietnam.

    Based on assay results, the Ministry of Agriculture and Rural Development shall add assayed items to the above-said list.

    5. Import of biologicals, microorganisms and enzymes for treatment and improvement of the aquaculture environment:

    a/ When importing biologicals, microorganisms and enzymes for treatment and improvement of the aquaculture environment on the list of those permitted for circulation in Vietnam promulgated by the Minister of Agriculture and Rural Development/the (former) Minister of Fisheries, traders shall directly carry out customs clearance procedures at customs offices without having to apply for permits.

    b/ For biologicals. microorganisms and enzymes for treatment and improvement of the aquaculture environment specified in Appendices 4 and 5 to this Circular and on the list of those subject to conditional import promulgated by the Minister of Agriculture and Rural Development/ the (former) Minister of Fisheries, which satisfy the conditions specified in these Appendices, traders shall directly carry out customs clearance procedures at customs offices without having to apply for permits.

    c/ Import of biologicals, microorganisms and enzymes for treatment and improvement of the aquaculture environment outside the list of those permitted for circulation in Vietnam and the list of those subject to conditional import in Appendices 4 and 5 to this Circular, requires import permits of the Aquaculture Department.

    d/ For biologicals, microorganisms and enzymes for treatment and improvement of the aquaculture environment imported for assay, after obtaining assay results and written certification by the Aquaculture Department that assayed items are up to quality standards promulgated by the Ministry of Agriculture and Rural Development, traders may import without permits these items pending the addition thereof to the list of biologicals, microorganisms and enzymes for use in treatment and improvement of the aquaculture environment permitted for circulation in Vietnam.

    Based on assay results, the Ministry of Agriculture and Rural Development shall recognize new biologicals, microorganisms and enzymes for treatment and improvement of the aquaculture environment and add them to the above-said list.

    Chapter III

    IMPLEMENTATION PROVISIONS

    Article 13. Organization of implementation

    1. Specialized management agencies assigned by the Ministry of Agriculture and Rural Development to receive and process dossiers and grant import, export and assay permits are located at the following addresses:

    a/ The Forestry Department (No. 2 Ngoc Ha street. Ba Dinh district, Hanoi city): for the cases specified in Article 3 (except Point b. Clause 2) of Chapter II.

    b/ The Forest Protection Department (No. 2 Ngoc Ha street, Ba Dinh district, Hanoi city): for the cases specified at Point b. Clause 2, Article 3, and Article 4, of Chapter II.

    c/ The Cultivation Department (No. 2 Ngoc Ha street, Ba Dinh district, Hanoi city): for the cases specified in Articles 5,10 and 11 of Chapter II.

    d/ The Husbandry Department (No. 2 Ngoc Ha street, Ba Dinh district, Hanoi city): for the cases specified in Articles 6 and 9 of Chapter II.

    e/ The Animal Health Department (No. 15, Alley 78, Giai Phong road, Phuong Mai ward, Dong Da district, Hanoi city): for the cases specified in Article 7, and Points a. b and c. Clause 4, Article 12, of Chapter II.

    f/ The Plant Protection Department (No. 149 Ho Dac Di street, Dong Da district, Hanoi city): for the cases specified in Article 8 of Chapter II.

    g/ The Aquaculture Department (No. 10 Nguyen Cong Hoan street, Ba Dinh district. Hanoi city): for the cases specified in Clause 2, and Points b and c. Clause 5, Article 12, of Chapter II.

    h/ The Aquatic Resource Exploitation and Protection Department (No. 10 Nguyen Cong Hoan street, Ba Dinh district. Hanoi city): for the cases specified at Point b. Clause 1, Article 12 of Chapter II.

    2. Dossiers and procedures for application for import permits shall be made and carried out according to forms set by the Ministry of Agriculture and Rural Development's specialized management agencies.

    3. The time limit for processing dossiers: Within 7 working days after receiving valid dossiers, the dossier-receiving agencies defined in Section 1 of this Chapter (Clause 1, Article 13) shall issue their written replies.

    4. The Ministry of Agriculture and Rural Development's specialized management agencies defined in Clause 1. Article 13 of Chapter III shall guide dossiers and procedures for application for import or export permits and coordinate with the General Department of Customs for application of HS codes to agricultural and fisheries goods as assigned under this Circular.

    5. When promulgating or revising lists of goods subject to specialized management by the agricultural sector mentioned in this Circular, the departments assigned by the Ministry of Agriculture and Rural Development to perform specialized management shall notify them to customs offices and concerned agencies.

    6. Traders shall be held responsible before law for the accuracy of their declarations before importing or exporting goods, and comply with current regulations on goods quality standards.

    Article 14. Effect

    1. This Circular takes effect 45 days from the date of its signing.

    2. This Circular replaces the following documents:

    - The Minister of Agriculture and Rural Development's Circular No. 32/2006/TT-BNN of May 8, 2006, guiding the Government's Decree No. 12/2006/ND-CP of January 23,2006, detailing the Commercial Law's provisions on international goods trading and goods trading, processing and transit agency with foreign countries.

    - The Minister of Agriculture and Rural Development's Circular No. 101/2007/TT-BNN of December 10, 2007, amending and supplementing a number of provisions of the Minister of Agriculture and Rural Development's Circular No. 32/2006rtT-BNN of May 8, 2006. guiding the Government's Decree No. 12/2006/ ND-CP of January 23, 2006, detailing the Commercial Law's provisions on international goods trading and goods trading, processing and transit agency with foreign countries.

    - The Minister of Agriculture and Rural Development's Circular No. 40/2008/TT-BNN of March 3, 2008, amending and supplementing Circular No. 101/2007/TT-BNN of December 10, 2007, amending and supplementing a number of provisions of Circular No. 32/2006/TT-BNN of May 8, 2006, guiding the Government's Decree No. 12/2006/ND-CP of January 23,2006, detailing the Commercial Law's provisions on international goods trading and goods trading, processing and transit agency with foreign countries.

    - The Minister of Fisheries' Decision No. 15/2006/QD-BTS  of September  8,  2006, promulgating the Regulation on management of import and export of fisheries goods.

    Any difficulties and problems arising in the course of implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development for timely amendment and supplementation.
