QUY ĐỊNH VỀ QUẢN LÝ GIỐNG THỦY SẢN, THỨC ĂN THỦY SẢN, SẢN PHẨM XỬ LÝ MÔI TRƯỜNG NUÔI TRỒNG THỦY SẢN
Căn cứ Nghị định số 15/2017/NĐ-CP ngày 17 tháng 02 năm 2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;
Căn cứ Luật Thủy sản năm 2017;
Theo đề nghị của Tổng cục trưởng Tổng cục Thủy sản;
Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Thông tư quy định về quản lý giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản.
Thông tư này hướng dẫn một số nội dung quy định tại khoản 2 Điều 23, khoản 2 Điều 31 Luật Thủy sản, gồm:
1. Hướng dẫn kiểm tra điều kiện của cơ sở sản xuất, ương dưỡng giống thủy sản; hướng dẫn kiểm tra điều kiện của cơ sở sản xuất, mua bán, nhập khẩu thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản;
2. Hướng dẫn kiểm tra chất lượng giống thủy sản trong sản xuất, lưu thông trên thị trường; hướng dẫn kiểm tra chất lượng thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trong sản xuất, lưu thông trên thị trường;
3. Quy định thời hạn sử dụng giống thủy sản bố mẹ;
4. Quy định đặt tên, sai số cho phép trong phân tích chất lượng, chỉ tiêu kỹ thuật phải công bố trong tiêu chuẩn công bố áp dụng của thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản;
5. Ban hành danh mục hóa chất, chế phẩm sinh học, vi sinh vật cấm sử dụng trong thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản; danh mục hóa chất, chế phẩm sinh học, vi sinh vật, nguyên liệu sản xuất thức ăn được phép sử dụng trong nuôi trồng thủy sản tại Việt Nam;
6. Quy định trình tự, thủ tục áp dụng biện pháp kỹ thuật xử lý vi phạm chất lượng giống thủy sản; quy định trình tự, thủ tục áp dụng biện pháp kỹ thuật xử lý thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản vi phạm quy định về chất lượng;
7. Hướng dẫn cập nhật thông tin về thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trước khi lưu thông trên thị trường.
Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên lãnh thổ Việt Nam.
1. Hình thức kiểm tra: Thực hiện bằng hình thức đoàn kiểm tra.
2. Căn cứ thành lập đoàn kiểm tra:
a) Đề nghị của cơ sở đối với trường hợp cấp mới, cấp lại giấy chứng nhận đủ điều kiện;
b) Thời gian kiểm tra duy trì điều kiện cơ sở đối với cơ sở đã được cấp giấy chứng nhận đủ điều kiện.
3. Thành phần đoàn kiểm tra gồm: Trưởng đoàn và thành viên; chuyên gia tư vấn khi cần thiết.
4. Yêu cầu đối với trưởng đoàn: Là lãnh đạo cấp phòng trở lên hoặc công chức có ít nhất 05 năm kinh nghiệm về một trong các lĩnh vực nuôi trồng thủy sản, giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản.
5. Yêu cầu đối với thành viên
Đoàn kiểm tra phải có ít nhất 01 thành viên đáp ứng yêu cầu sau:
a) Đã tham gia lớp tập huấn nghiệp vụ kiểm tra điều kiện cơ sở do Tổng cục Thủy sản tổ chức;
b) Thành viên đoàn kiểm tra điều kiện cơ sở sản xuất, ương dưỡng giống thủy sản phải có trình độ đại học trở lên một trong các lĩnh vực nuôi trồng thủy sản, bệnh học thủy sản, sinh học, môi trường;
c) Thành viên đoàn kiểm tra điều kiện cơ sở sản xuất thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản phải có trình độ đại học trở lên một trong các lĩnh vực nuôi trồng thủy sản, bệnh học thủy sản, sinh học, hóa học, công nghệ thực phẩm, môi trường.
6. Yêu cầu đối với người lấy mẫu giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản: Đã tham gia lớp tập huấn nghiệp vụ về lấy mẫu giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản do Tổng cục Thủy sản tổ chức.
1. Cơ quan kiểm tra: Cơ quan quản lý nhà nước về thủy sản cấp tỉnh kiểm tra điều kiện cơ sở mua bán, nhập khẩu thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên địa bàn.
2. Hình thức kiểm tra: Thực hiện đồng thời với hoạt động kiểm tra chất lượng sản phẩm lưu thông trên thị trường theo quy định tại Điều 7 Thông tư này.
3. Nội dung kiểm tra: Theo quy định tại Điều 33 Luật Thủy sản.
Điều 5. Tập huấn nghiệp vụ kiểm tra điều kiện cơ sở và lấy mẫu
1. Tổng cục Thủy sản tổ chức tập huấn nghiệp vụ kiểm tra điều kiện cơ sở và lấy mẫu giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản cho cán bộ thuộc cơ quan kiểm tra.
2. Nội dung tập huấn nghiệp vụ kiểm tra điều kiện cơ sở gồm: Quy định về điều kiện cơ sở sản xuất, ương dưỡng giống thủy sản, điều kiện cơ sở sản xuất thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản; tiêu chuẩn và quy chuẩn kỹ thuật liên quan đến giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản; hệ thống quản lý chất lượng, an toàn sinh học.
3. Nội dung tập huấn nghiệp vụ lấy mẫu gồm: Quy định liên quan đến lĩnh vực kiểm tra, đối tượng kiểm tra; tiêu chuẩn và quy chuẩn kỹ thuật về bảo đảm an toàn cho người lấy mẫu, phương pháp lấy mẫu, bảo quản mẫu; thực hành lấy mẫu tại cơ sở.
KIỂM TRA CHẤT LƯỢNG GIỐNG THỦY SẢN, THỨC ĂN THỦY SẢN, SẢN PHẨM XỬ LÝ MÔI TRƯỜNG NUÔI TRỒNG THỦY SẢN
1. Cơ quan kiểm tra
a) Tổng cục Thủy sản: Kiểm tra chất lượng giống thủy sản bố mẹ; kiểm tra chất lượng thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản đối với nhà đầu tư nước ngoài, tổ chức kinh tế có vốn đầu tư nước ngoài.
b) Cơ quan quản lý nhà nước về thủy sản cấp tỉnh: Kiểm tra chất lượng giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên địa bàn, trừ trường hợp quy định tại điểm a khoản 1 Điều này; kiểm tra chất lượng giống thủy sản bố mẹ hoặc kiểm tra thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản đối với nhà đầu tư nước ngoài, tổ chức kinh tế có vốn đầu tư nước ngoài khi được Tổng cục Thủy sản ủy quyền.
2. Căn cứ kiểm tra:
a) Quy định tại Điều 32 Luật Chất lượng sản phẩm, hàng hóa;
b) Tiêu chuẩn công bố áp dụng, quy chuẩn kỹ thuật, quy định của Bộ Nông nghiệp và Phát triển nông thôn.
3. Nội dung kiểm tra:
a) Kiểm tra sự phù hợp với tiêu chuẩn công bố áp dụng, quy chuẩn kỹ thuật quốc gia tương ứng, quy định của Bộ Nông nghiệp và Phát triển nông thôn; kiểm tra kết quả đánh giá sự phù hợp, ghi nhãn, dấu hợp chuẩn, dấu hợp quy và hồ sơ trong quá trình sản xuất, ương dưỡng. Trong trường hợp cần thiết, cơ quan kiểm tra có thể sử dụng chuyên gia thực hiện việc đánh giá theo các yêu cầu của quy chuẩn kỹ thuật tương ứng;
b) Lấy mẫu thử nghiệm khi phát hiện có dấu hiệu không bảo đảm chất lượng sau khi thực hiện các nội dung quy định tại điểm a khoản 3 Điều này.
4. Người lấy mẫu phải đáp ứng yêu cầu theo quy định tại khoản 6 Điều 3 Thông tư này.
5. Sai số cho phép trong phân tích chất lượng thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản theo quy định tại Phụ lục III ban hành kèm theo Thông tư này.
6. Trình tự và thủ tục kiểm tra thực hiện theo quy định tại khoản 3 Điều 29 Luật Chất lượng sản phẩm, hàng hóa.
7. Xử lý kết quả kiểm tra chất lượng thực hiện theo quy định tại Điều 30 Luật Chất lượng sản phẩm, hàng hóa và Điều 6 Nghị định số 132/2008/NĐ-CP ngày 31 tháng 12 năm 2008 của Chính phủ hướng dẫn Luật Chất lượng sản phẩm, hàng hóa.
1. Cơ quan kiểm tra: Cơ quan quản lý nhà nước về thủy sản cấp tỉnh kiểm tra chất lượng giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên địa bàn.
2. Nội dung, trình tự, thủ tục tiến hành kiểm tra chất lượng giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản lưu thông trên thị trường thực hiện theo quy định tại Thông tư số 26/2012/TT-BKHCN ngày 12 tháng 12 năm 2012 của Bộ Khoa học và Công nghệ quy định việc kiểm tra nhà nước về chất lượng hàng hóa lưu thông trên thị trường và Thông tư số 12/2017/TT-BKHCN ngày 28 tháng 9 năm 2017 sửa đổi, bổ sung một số điều của Thông tư số 26/2012/TT-BKHCN ngày 12 tháng 12 năm 2012 của Bộ trưởng Bộ Khoa học và Công nghệ quy định việc kiểm tra nhà nước về chất lượng hàng hóa lưu thông trên thị trường.
3. Người lấy mẫu phải đáp ứng yêu cầu theo quy định tại khoản 6 Điều 3 Thông tư này.
4. Sai số cho phép trong phân tích chất lượng thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản theo quy định tại Phụ lục III ban hành kèm theo Thông tư này.
Điều 8. Trình tự, thủ tục áp dụng biện pháp kỹ thuật xử lý vi phạm chất lượng giống thủy sản
1. Giống thủy sản vi phạm chất lượng phải tiêu hủy được thực hiện theo trình tự, thủ tục sau:
a) Áp dụng một trong các biện pháp sau để tiêu hủy: Gia nhiệt từ 90°C trở lên, cấp đông, sử dụng hóa chất được phép sử dụng trong nuôi trồng thủy sản, hình thức khác theo quy định của pháp luật.
b) Lập biên bản tiêu hủy: Biên bản tiêu hủy phải có đầy đủ chữ ký của đại diện cơ quan kiểm tra và cơ sở vi phạm. Nội dung chủ yếu của biên bản gồm: Căn cứ và lý do thực hiện tiêu hủy; thời gian, địa điểm tiêu hủy; thành phần tham gia tiêu hủy; tên, chủng loại, nguồn gốc, xuất xứ, số lượng, hiện trạng giống thủy sản vi phạm tại thời điểm tiêu hủy; hình thức tiêu hủy và các nội dung khác có liên quan.
2. Giống thủy sản vi phạm chất lượng được chuyển mục đích sử dụng thực hiện theo trình tự, thủ tục sau:
a) Áp dụng một trong các biện pháp sau để chuyển đổi mục đích sử dụng: Làm cảnh, giải trí, nghiên cứu khoa học;
b) Cơ sở phải có phương án chuyển mục đích sử dụng và báo cáo cho cơ quan quản lý nhà nước về thủy sản cấp tỉnh để thực hiện quản lý, giám sát quá trình chuyển mục đích sử dụng.
1. Thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản vi phạm chất lượng phải tiêu hủy thực hiện theo trình tự, thủ tục sau:
a) Áp dụng một hoặc một số biện pháp sau để tiêu hủy: Sử dụng hóa chất, sử dụng biện pháp cơ học, đốt, chôn, hình thức khác theo quy định của pháp luật;
b) Lập biên bản tiêu hủy: Biên bản tiêu hủy phải có đầy đủ chữ ký của đại diện cơ quan kiểm tra và cơ sở vi phạm. Nội dung chủ yếu của biên bản gồm: Căn cứ và lý do thực hiện tiêu hủy; thời gian, địa điểm tiêu hủy; thành phần tham gia tiêu hủy; tên, chủng loại, nguồn gốc, xuất xứ, số lượng, hiện trạng sản phẩm vi phạm tại thời điểm tiêu hủy; hình thức tiêu hủy và các nội dung khác có liên quan.
2. Thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản vi phạm chất lượng được tái chế, chuyển mục đích sử dụng thực hiện theo trình tự, thủ tục sau:
a) Đối với biện pháp tái chế: Cơ sở phải có phương án tái chế và báo cáo cho cơ quan quản lý nhà nước về thủy sản cấp tỉnh để thực hiện quản lý, giám sát quá trình tái chế;
b) Đối với biện pháp chuyển mục đích sử dụng: Cơ sở phải có phương án chuyển mục đích sử dụng đáp ứng quy định của pháp luật về sản phẩm sau khi chuyển đổi và báo cáo cho cơ quan quản lý nhà nước về thủy sản cấp tỉnh để thực hiện quản lý, giám sát quá trình chuyển mục đích sử dụng.
Điều 10. Thời hạn sử dụng giống thủy sản bố mẹ
Thời hạn sử dụng giống thủy sản bố mẹ theo quy chuẩn kỹ thuật quốc gia tương ứng. Trường hợp chưa có quy chuẩn kỹ thuật quốc gia, thời hạn sử dụng giống thủy sản bố mẹ được quy định như sau:
1. Tôm thẻ chân trắng bố mẹ
b) Thời hạn sử dụng tối đa 120 ngày tính từ ngày cho sinh sản lần đầu đối với tôm bố mẹ sản xuất trong nước hoặc tôm bố mẹ nhập khẩu chưa đạt khối lượng theo quy định tại điểm a khoản 1 Điều này.
2. Tôm sú bố mẹ
b) Thời hạn sử dụng tối đa 60 ngày tính từ ngày cho sinh sản lần đầu đối với tôm bố mẹ sản xuất trong nước, tôm bố mẹ khai thác từ tự nhiên, tôm bố mẹ nhập khẩu chưa đạt khối lượng theo quy định tại điểm a khoản 2 Điều này.
3. Cá tra bố mẹ: Thời hạn sử dụng tối đa 60 tháng tính từ ngày cho sinh sản lần đầu và cho sinh sản không quá 02 lần/năm.
4. Thời hạn sử dụng giống thủy sản bố mẹ khác: Cơ sở tự công bố.
1. Danh mục hóa chất, chế phẩm sinh học, vi sinh vật cấm sử dụng trong thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản được quy định tại Phụ lục I ban hành kèm theo Thông tư này.
2. Danh mục hóa chất, chế phẩm sinh học, vi sinh vật, nguyên liệu sản xuất thức ăn được phép sử dụng trong nuôi trồng thủy sản tại Việt Nam được quy định tại Phụ lục II ban hành kèm theo Thông tư này.
3. Chỉ tiêu kỹ thuật phải công bố trong tiêu chuẩn công bố áp dụng của thức ăn, sản phẩm xử lý môi trường trong nuôi trồng thủy sản được quy định tại Phụ lục IV ban hành kèm theo Thông tư này.
CẬP NHẬT THÔNG TIN THỨC ĂN THỦY SẢN, SẢN PHẨM XỬ LÝ MÔI TRƯỜNG NUÔI TRỒNG THỦY SẢN
1. Cơ sở sản xuất, nhập khẩu thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản lập tài khoản để đăng nhập vào hệ thống cơ sở dữ liệu quốc gia về thủy sản, thông tin lập tài khoản gồm:
a) Tên đăng nhập là mã số doanh nghiệp hoặc mã số thuế;
b) Thông tin kê khai khi lập tài khoản gồm: Tên cơ sở, địa chỉ trụ sở chính, điện thoại, email, địa chỉ sản xuất, điều kiện sản xuất, loại hình doanh nghiệp.
2. Trước khi đưa sản phẩm lưu thông trên thị trường, cơ sở sản xuất, nhập khẩu phải gửi thông tin về thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản theo quy định tại Điều 13 Thông tư này qua tài khoản được lập theo quy định tại khoản 1 Điều này.
Điều 13. Thông tin thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản
1. Thông tin thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản sản xuất trong nước, gồm: Thông tin về địa điểm và điều kiện sản xuất; thông tin tiêu chuẩn công bố áp dụng theo Phụ lục V ban hành kèm theo Thông tư này; thông tin công bố hợp quy; nhãn của sản phẩm (bản sao chụp màu); kết quả thử nghiệm chất lượng sản phẩm.
2. Thông tin thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản nhập khẩu, gồm: Thông tin về cơ sở sản xuất, địa điểm và điều kiện sản xuất; thông tin tiêu chuẩn công bố áp dụng theo Phụ lục V ban hành kèm theo Thông tư này; thông tin công bố hợp quy; nhãn của sản phẩm (bản sao chụp màu nhãn gốc và nhãn bằng tiếng Việt); Giấy chứng nhận lưu hành tự do (Certificate of free sale) hoặc văn bản có giá trị tương đương còn hiệu lực; kết quả kiểm tra chất lượng khi nhập khẩu.
a) AA: Mã số để phân loại thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản: 01 là mã thức ăn thủy sản; 02 là mã sản phẩm xử lý môi trường nuôi trồng thủy sản; 03 là mã sản phẩm sử dụng cả 02 mục đích làm thức ăn thủy sản và xử lý môi trường nuôi trồng thủy sản;
b) BBBBBB: Số thứ tự sản phẩm thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản được cấp theo thứ tự từ 000001 đến 999999.
4. Khi có bất kỳ sự thay đổi về thông tin đã cập nhật theo khoản 1 và khoản 2 Điều này, cơ sở phải cập nhật lại trước khi đưa sản phẩm lưu thông trên thị trường.
Điều 14. Quy định về đặt tên thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản
Tên thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản thực hiện theo quy định tại Điều 11 Nghị định số 43/2017/NĐ-CP ngày 14 tháng 4 năm 2017 của Chính phủ về nhãn hàng hóa.
Điều 15. Trách nhiệm của các bên có liên quan
1. Tổng cục Thủy sản:
a) Quản lý nhà nước về giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên phạm vi cả nước. Chỉ đạo, hướng dẫn chuyên môn, nghiệp vụ liên quan đến quản lý giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản;
b) Thanh tra, kiểm tra về giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên phạm vi cả nước; kiểm tra trách nhiệm của cơ quan quản lý nhà nước về thủy sản cấp tỉnh về giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản;
c) Tập huấn nghiệp vụ kiểm tra điều kiện cơ sở, lấy mẫu giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản; tập huấn, tuyên truyền, hướng dẫn về điều kiện sản xuất, quản lý chất lượng giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản cho tổ chức, cá nhân;
d) Rà soát, cập nhật và trình Bộ Nông nghiệp và Phát triển nông thôn ban hành: Danh mục hóa chất, chế phẩm sinh học, vi sinh vật cấm sử dụng trong thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản; danh mục hóa chất, chế phẩm sinh học, vi sinh vật, nguyên liệu sản xuất thức ăn được phép sử dụng trong nuôi trồng thủy sản tại Việt Nam;
2. Cơ quan quản lý nhà nước về thủy sản cấp tỉnh:
a) Quản lý nhà nước về giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên địa bàn; thanh tra, kiểm tra về giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên địa bàn;
b) Tổ chức tập huấn, phổ biến các quy định của pháp luật về giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên địa bàn;
c) Thực hiện các nhiệm vụ khác liên quan đến quản lý giống thủy sản, thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trên địa bàn khi Tổng cục Thủy sản ủy quyền.
3. Cơ sở sản xuất, nhập khẩu thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản:
a) Cập nhật thông tin thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản trước khi lưu thông trên thị trường theo quy định;
b) Định kỳ báo cáo tình hình sản xuất, nhập khẩu thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản 6 tháng đầu năm trước ngày 20 tháng 6 hàng năm và báo cáo năm trước ngày 20 tháng 12 hàng năm theo mẫu tại Phụ lục VI kèm theo Thông tư này.
4. Cơ sở sản xuất, ương dưỡng giống thủy sản:
a) Định kỳ báo cáo tình hình sản xuất, ương dưỡng giống thủy sản 6 tháng đầu năm trước ngày 20 tháng 6 hàng năm và báo cáo năm trước ngày 20 tháng 12 hàng năm theo mẫu tại Phụ lục VII kèm theo Thông tư này;
b) Thông báo bằng văn bản cho cơ quan quản lý nhà nước về thủy sản cấp tỉnh về việc sử dụng giống thủy sản bố mẹ để quản lý, giám sát thời hạn sử dụng.
1. Thông tư này có hiệu lực thi hành kể từ ngày 01 tháng 01 năm 2019.
2. Thông tư này thay thế các văn bản sau:
a) Quyết định số 10/2007/QĐ-BTS ngày 31 tháng 7 năm 2007 của Bộ trưởng Bộ Thủy sản ban hành Danh mục thuốc thú y thủy sản, sản phẩm xử lý cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
b) Quyết định số 06/2008/QĐ-BNN ngày 18 tháng 01 năm 2008 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc bổ sung, sửa đổi Danh mục thuốc thú y thủy sản, sản phẩm xử lý cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
c) Quyết định số 108/2008/QĐ-BNN ngày 06 tháng 11 năm 2008 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục bổ sung sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
d) Quyết định số 123/2008/QĐ-BNN ngày 29 tháng 12 năm 2008 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục thức ăn hỗn hợp dùng trong nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
đ) Thông tư số 57/2009/TT-BNNPTNT ngày 08 tháng 9 năm 2009 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục bổ sung sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
e) Thông tư số 67/2009/TT-BNNPTNT ngày 23 tháng 10 năm 2009 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục bổ sung thức ăn hỗn hợp được phép lưu hành tại Việt Nam;
g) Thông tư số 71/2009/TT-BNNPTNT ngày 10 tháng 11 năm 2009 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục bổ sung sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
h) Thông tư số 74/2009/TT-BNNPTNT ngày 20 tháng 11 năm 2009 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục bổ sung thức ăn hỗn hợp được phép lưu hành tại Việt Nam;
i) Thông tư số 12/2010/TT-BNNPTNT ngày 11 tháng 3 năm 2010 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục bổ sung sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
k) Thông tư số 13/2010/TT-BNNPTNT ngày 12 tháng 3 năm 2010 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục bổ sung thức ăn hỗn hợp được phép lưu hành tại Việt Nam;
l) Thông tư số 64/2010/TT-BNNPTNT ngày 4 tháng 11 năm 2010 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc đưa các sản phẩm có chứa trifluralin ra khỏi danh mục sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
m) Thông tư số 62/2011/TT-BNNPTNT ngày 14 tháng 9 năm 2011 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục sửa đổi, bổ sung thức ăn thủy sản được phép lưu hành tại Việt Nam;
n) Thông tư số 65/2011/TT-BNNPTNT ngày 5 tháng 10 năm 2011 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục bổ sung sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
o) Thông tư số 04/2012/TT-BNNPTNT ngày 16 tháng 01 năm 2012 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn đưa các sản phẩm có chứa Cypermethrin, Deltamethrin ra khỏi Danh mục sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản; thuốc thú y thủy sản được phép lưu hành tại Việt Nam;
p) Thông tư số 36/2012/TT-BNNPTNT ngày 30 tháng 7 năm 2012 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục sửa đổi, bổ sung sản phẩm thức ăn thủy sản được phép lưu hành tại Việt Nam;
q) Thông tư số 37/2012/TT-BNNPTNT ngày 30 tháng 7 năm 2012 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục sửa đổi, bổ sung sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
r) Thông tư số 26/2013/TT-BNNPTNT ngày 22 tháng 5 năm 2013 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về quản lý giống thủy sản;
s) Thông tư số 08/2013/TT-BNNPTNT ngày 31 tháng 01 năm 2013 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục sửa đổi, bổ sung sản phẩm thức ăn thủy sản được phép lưu hành tại Việt Nam;
t) Thông tư số 09/2013/TT-BNNPTNT ngày 31 tháng 01 năm 2013 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục sửa đổi, bổ sung sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
u) Thông tư số 39/2013/TT-BNNPTNT ngày 12 tháng 8 năm 2013 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Danh mục bổ sung, sửa đổi thức ăn thủy sản; sản phẩm xử lý, cải tạo môi trường nuôi trồng thủy sản được phép lưu hành tại Việt Nam;
ư) Thông tư số 11/2014/TT-BNNPTNT ngày 01 tháng 4 năm 2014 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn sửa đổi, bổ sung Phụ lục 4 ban hành kèm theo Thông tư số 26/2013/TT-BNNPTNT ngày 22 tháng 5 năm 2013 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về quản lý giống thủy sản.
3. Thông tư này bãi bỏ các quy định, văn bản sau:
a) Quyết định số 176/QĐ-BTS ngày 01 tháng 3 năm 2006 của Bộ trưởng Bộ Thủy sản về việc ban hành một số quy định tạm thời đối với tôm thẻ chân trắng;
b) Quyết định số 456/QĐ-BNN-NTTS ngày 04 tháng 02 năm 2008 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn quy định điều kiện sản xuất giống, nuôi tôm chân trắng;
c) Quyết định số 1673/QĐ-BNN-TCTS ngày 22 tháng 7 năm 2013 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành quy chế quản lý cá tra bố mẹ chọn giống;
d) Cụm từ Saponin từ bột hạt trà, Rotenon có số thứ tự 14 và 15 tại Phụ lục XLIV ban hành kèm theo Thông tư số 13/2016/TT-BNNPTNT ngày 02 tháng 6 năm 2016 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn quy định về quản lý thuốc thú y;
đ) Khoản 6 Điều 3, Điều 31 và Điều 32 Thông tư số 04/2015/TT-BNNPTNT ngày 12 tháng 02 năm 2015 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn thực hiện một số nội dung của Nghị định số 187/2013/NĐ-CP ngày 20/11/2013 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hóa quốc tế và các hoạt động đại lý, mua, bán, gia công và quá cảnh hàng hóa với nước ngoài trong lĩnh vực nông nghiệp, lâm nghiệp và thủy sản;
e) Nội dung quản lý về thức ăn thủy sản tại Thông tư số 20/2017/TT-BNNPTNT ngày 10 tháng 11 năm 2017 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn thực hiện Nghị định số 39/2017/NĐ-CP ngày 04 tháng 4 năm 2017 của Chính phủ về quản lý thức ăn chăn nuôi, thủy sản.
Điều 17. Điều khoản chuyển tiếp
1. Thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản đã được xác nhận lưu hành trước ngày Thông tư này có hiệu lực được tiếp tục sản xuất, nhập khẩu đến ngày 01 tháng 01 năm 2020 và lưu thông, sử dụng đến hết thời hạn sử dụng của sản phẩm.
2. Sản phẩm có chứa Saponin từ bột hạt trà, Rotenon đã được lưu hành theo quy định tại Thông tư số 13/2016/TT-BNNPTNT ngày 02 tháng 6 năm 2016 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn quy định về quản lý thuốc thú y trước ngày Thông tư này có hiệu lực được tiếp tục sản xuất, nhập khẩu đến hết thời hạn của Giấy chứng nhận lưu hành thuốc thú y và được sử dụng đến hết hạn sử dụng của sản phẩm.
1. Trường hợp các văn bản dẫn chiếu tại Thông tư này được sửa đổi, bổ sung, thay thế thì áp dụng theo các văn bản sửa đổi, bổ sung, thay thế đó.
2. Trong quá trình thực hiện nếu có khó khăn vướng mắc hoặc phát hiện những vấn đề mới phát sinh, tổ chức, cá nhân kịp thời báo cáo về Tổng cục Thủy sản để tổng hợp, báo cáo Bộ Nông nghiệp và Phát triển nông thôn để xem xét, sửa đổi bổ sung cho phù hợp./.

Ghi chú:
(1) Hàm lượng thành phần, hoạt chất công bố trên nhãn sản phẩm hoặc tiêu chuẩn cơ sở.
(2) Đơn vị tính khác (g/kg, g/l, mg/kg, mg/l, mg/g, mg/ml,...) được quy về % hoặc ppm hoặc ppb. Đối với các chỉ tiêu chưa được quy định hàm lượng và đơn vị tính tại bảng trên thì sai số cho phép là ± 15 %.
(3) Công thức tính sai số: Sai số trong kiểm tra chất lượng được tính theo công thức:
S (%) = (A-B) x 100/B
Trong đó:
S: Sai số trong kiểm tra chất lượng;
A: Kết quả thử nghiệm chất lượng;
B: Hàm lượng do cơ sở công bố.
Kết quả:
Đạt: Nếu S nằm trong khoảng sai số cho phép.
Không đạt: Nếu S nằm ngoài khoảng sai số cho phép.
Trường hợp công bố hàm lượng trong khoảng: Kết quả thử nghiệm nhỏ hơn hàm lượng ngưỡng dưới thì B là giá trị công bố ngưỡng dưới; kết quả thử nghiệm lớn hơn hàm lượng công bố ngưỡng trên thì B là giá trị công bố ngưỡng trên.

CIRCULAR
PRESCRIBING MANAGEMENT OF AQUATIC BREEDS, AQUATIC FEEDS AND AQUA ENVIRONMENTAL REMEDIATION PRODUCTS
Pursuant to the Government's Decree No. 15/2017/ND-CP dated February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the 2017 Law on Fishery;
Upon the request of the Director of the Directorate of Fisheries;
The Minister of Agriculture and Rural Development hereby promulgates the Circular prescribing the management of aquatic breeds, aquatic feeds and aqua environmental remediation products.
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Circular provides instructions about certain regulations laid down in clause 2 of Article 23 and clause 2 of Article 31 in the Law on Fishery, includes:
1. Instructions on the inspection of conditions of aquatic breeding and cultivation facilities; instructions on conditions of aquatic feed and aqua environmental product manufacturing, trading and importing establishments;
2. Instructions on the inspection of quality of aquatic breeds which are manufactured and obtain the marketing authorization; instructions on the inspection of quality of aquatic feeds and aqua environmental products which are manufactured and obtain the marketing authorization;
3. Prescribed time limits for use of aquatic parent breeds;
4. Rules of naming, allowable variances used in analysis of quality and technical indicators that must be announced by applicable standards of aquatic feeds and aqua environmental remediation products;
5. Release of the list of chemicals, biologicals and microorganisms prohibited for use in the formulation of aquatic feeds and aqua environmental remediation products; the list of chemicals, biologicals, microorganisms and ingredients contained in aquatic feeds permitted for use in Vietnam;
6. Regulations on procedures and processes for application of technical measures for handling of violations related to the quality of aquatic breeds; regulations on procedures and processes for application of technical measures for disposal of aquatic feeds and aqua environmental remediation products in violation of quality regulations;
7. Instructions on update of information about aquatic feeds and aqua environmental remediation products before free sale on the market.
Article 2. Subjects of application
This Circular shall apply to organizations and individuals involved in the business of aquatic breeds, aquatic feeds and aqua environmental remediation products within the territory of Vietnam.
Chapter II
INSPECTION OF CONDITIONS OF AQUATIC BREEDING AND CULTIVATION FACILITIES, AQUATIC FEED AND AQUA ENVIRONMENTAL PRODUCT MANUFACTURING, TRADING AND IMPORTING ESTABLISHMENTS
Article 3. Conditions of aquatic breeding and cultivation facilities, aquatic feed and aqua environmental product manufacturing, trading and importing establishments
1. Inspection form: The inspection shall be carried out by an Inspector Commission.
2. Bases for establishment of the Inspector Commission:
a) A facility's request for issuance and reissuance of the certificate of compliance;
b) Time of inspection of maintenance of compliance of the facility that has already been granted the certificate of compliance.
3. The Inspector Commission shall be composed of: Head and members; consultant (if necessary).
4. Eligibility requirements of the Head: The Head must be the division-level leader or the person holding a higher position, or a public officer acquiring at least 5 years’ experience in one of such sectors as aquaculture, aquatic breeds, aquatic feeds and aqua environmental remediation products.
5. Eligibility requirements of members
The Inspection Commission must be composed of one or more members who meet the following requirements:
a) Have already completed training courses in inspection of conditions of to-be-inspected facilities that are offered by the Directorate of Fisheries;
b) Regarding members of the Inspector Commission for conditions of aquatic breeding and cultivation facilities, they must hold undergraduate or higher degrees in aquaculture, aquatic pathology, biology or environment majors;
c) Regarding members of the Inspector Commission for conditions of aquatic breeding and cultivation facilities, they must hold undergraduate or higher degrees in aquaculture, aquatic pathology, biology or environmental studies majors.
6. Eligibility requirements of collectors of samples of aquatic breeds, aquatic feeds and aqua environmental remediation products: They must have completed training courses in collection of samples of aquatic breeds, aquatic feeds and aqua environmental remediation products that are offered by the Directorate of Fisheries.
Article 4. Inspection of conditions of aquatic feed and aqua environmental product manufacturing, trading and importing establishments
1. Inspection authorities: Provincial-level fishery regulatory authorities shall undertake the inspection of conditions of aquatic feed and aqua environmental product manufacturing, trading and importing establishments within their remit.
2. Inspection forms: This inspection shall coincide with the inspection of quality of products authorized for marketing in accordance with Article 7 hereof.
3. Subjects of this inspection: They have been defined in Article 33 of the Law on Fishery.
Article 5. Inspection and sampling training
1. Directorate of Fisheries shall provide staff of inspection authorities with training in inspection of conditions of facilities and collection of samples of aquatic breeds, aquatic feeds and aqua environmental remediation products.
2. Inspection training contents: The inspection training shall provide regulations on conditions of aquatic breeding and cultivation facilities, those of aquatic feed and aqua environmental remediation product manufacturing facilities; technical standards and regulations on aquatic breeds, aquatic feeds and aqua environmental remediation products; quality management and biosafety systems.
3. Sampling training contents: The sampling training shall provide regulations related to scope and subjects of inspection; technical standards and regulations on assurance of safety for sample collectors, sampling and sample storage methods; shall organize on-site sampling practice classes.
Chapter III
INSPECTION OF QUALITY OF AQUATIC BREEDS, AQUATIC FEEDS AND AQUA ENVIRONMENTAL REMEDIATION PRODUCTS
Article 6. Inspection of quality of aquatic breeds used in aquatic breeding and cultivation activities; Inspection of quality of aquatic feeds and aqua environmental remediation products used in aquatic production activities
1. Inspection authorities:
a) Directorate of Fisheries: The Directorate of Fisheries shall be accorded authority over the inspection of quality of aquatic parent breeds and the inspection of quality of aquatic feeds and aqua environmental remediation products for foreign investors and foreign-invested economic institutes.
b) Provincial-level fishery regulatory authorities: They may be accorded authority by the Directorate of Fisheries over the inspection of quality of aquatic breeds, aquatic feeds and aqua environmental remediation products within their remit, unless otherwise prescribed in point a of clause 1 of this Article, the inspection of quality of aquatic parent breeds or the inspection of aquatic feeds and aqua environmental remediation products with respect to foreign investors and foreign-invested economic institutes.
2. Inspection bases:
a) Regulations laid down in Article 32 of the Law on Quality of Products and Commodities;
b) Applicable standards, technical regulations and other regulations of the Ministry of Agriculture and Rural Development.
3. Subjects of these inspections:
a) These inspections must be aimed at inspecting the compliance with corresponding applicable standards and national technical regulations and other regulations of the Ministry of Agriculture and Rural Development; compliance assessment results, labeling, regulatory compliance or conformity marks, records or documents created during aquatic breeding and cultivation processes. Where necessary, inspection authorities may hire independent experts to carry out assessment in accordance with corresponding technical regulations;
b) In case of discovering any sign of quality assurance failure after carrying out the inspection stated in point a of clause 3 of this Article, collection of samples for testing shall be required.
4. Sample collectors must meet requirements defined in clause 6 of Article 3 herein.
5. Variances that may be accepted for the analysis of aquatic feeds and aqua environmental remediation products shall be subject to regulations enshrined in the Appendix III hereto.
6. Inspection procedures and processes shall be subject to clause 3 of Article 29 in the Law on Quality of Products and Commodities.
7. Handling of quality inspection results shall be subject to Article 30 in the Law on Quality of Products and Commodities and Article 6 in the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008, providing instructions on the Law on Quality of Products and Commodities.
Article 7. Inspection of quality of aquatic breeds, aquatic feeds and aqua environmental remediation products in circulation on the market
1. Inspection authorities: Provincial-level fishery regulatory authorities shall undertake the inspection of quality of aquatic breeds, aquatic feeds and aqua environmental products within their remit.
2. Subjects, procedures and processes of inspection of quality of aquatic breeds, aquatic feeds and aqua environmental remediation products in circulation on the market shall be subject to regulations laid down in the Circular No. 26/2012/TT-BKHCN dated December 12, 2012 of the Ministry of Science and Technology on the state inspection of quality of goods sold on the market and the Circular No. 12/2017/TT-BKHCN dated September 28, 2017 on amendments and supplements to certain articles of the Circular No. 26/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology on the state management of quality of goods in circulation on the market.
3. Sample collectors must meet requirements defined in clause 6 of Article 3 herein.
4. Variances that may be accepted for the analysis of aquatic feeds and aqua environmental remediation products shall be subject to regulations enshrined in the Appendix III hereto.
Article 8. Processes and procedures for application of technical measures to handle violation of quality of aquatic breeds
1. Aquatic breeds in breach of prescribed quality regulations shall be eliminated according to the following processes and procedures:
a) One of the following elimination methods shall be applied: Violating aquatic breeds shall be heated at the temperature of 90°C or above, frozen or eliminated by chemicals permitted for use in aquatic production activities or in other forms in accordance with law.
b) Preparation of elimination reports: Elimination reports must be signed by all signatures of representatives of inspection authorities and violating facilities. These reports shall comprise the following main information: Sound grounds and reasons for elimination; time and location of elimination; participants in elimination activities; names, types, origins, origin certificates, quantity and current status of violating aquatic breeds determined at the time of elimination; forms of elimination and other relevant information.
2. Alteration of purposes of aquatic breeds in breach of prescribed quality regulations shall be made according to the following processes and procedures:
a) Apply one of the following methods for alteration of purposes, including using them for ornamental, entertainment and scientific research purposes;
b) Violating facilities must work out plans for purpose alteration and report to provincial-level fishery regulatory authorities to request their management and oversight of purpose alteration processes.
Article 9. Processes and procedures for application of technical measures to dispose of aquatic feeds and aqua environmental remediation products in breach of quality regulations
1. Aquatic feeds and aqua environmental remediation products in breach of quality regulations must be disposed of according to the following processes and procedures:
a) One of the following elimination methods shall be applied: Using chemicals, using mechanical methods, burning, burying or using other elimination methods in accordance with law;
b) Preparation of elimination reports: Elimination reports must be signed by all signatures of representatives of inspection authorities and violating facilities. These reports shall comprise the following main information: Sound grounds and reasons for elimination; time and location of elimination; participants in elimination activities; names, types, origins, origin certificates, quantity and current status of violating products determined at the time of elimination; forms of elimination and other relevant information.
2. Aquatic feeds and aqua environmental remediation products in breach of quality regulations may be recycled or altered according to the following processes and procedures:
a) Recycling method: b) Violating facilities must work out plans for recycling and report to provincial-level fishery regulatory authorities to request their management and oversight of recycling procedures;
b) Purpose alteration method: Violating facilities must work out plans for purpose alteration activities in conformance to law on products after alteration and report to provincial-level fishery regulatory authorities to request their management and oversight of purpose alteration activities.
Article 10. Prescribed time limits for use of aquatic parent breeds
Time limits for use of aquatic parent breeds shall be subject to corresponding national technical regulations. In the absence of national technical regulations, time limits for use of aquatic parent breeds shall be regulated as follows:
1. Parent whiteleg shrimp breeds
a) The maximum time limit for use of an imported parent whiteleg shrimp shall be 140 days from the customs clearance date with respect to the male or female one which is 40 g or 45 per each in minimum weight, respectively.
b) The maximum time limit for use of a domestically-bred or imported parent whiteleg shrimp of which the minimum weight does not meet regulations enshrined in point a of clause 1 of this Article shall be 120 days from the first egg-laying date.
2. Parent giant tiger prawn breeds
a) The maximum time limit for use of an imported male or female whiteleg shrimp of which the minimum weight is 100 g or 120 g per each, respectively, shall be 80 days from the customs clearance date.
b) The maximum time limit for use of a domestically-bred, domesticated or imported parent whiteleg shrimp of which the minimum weight does not meet regulations enshrined in point a of clause 2 of this Article shall be 60 days from the first egg laying date.
3. Parent pangasius fish breeds: The maximum time limit for use thereof shall be 60 months after they give birth to baby fish for the first time. The number of birth-giving times shall be restricted to 02 per year.
4. Time limits for use of other aquatic parent breeds: Facilities may determine these time limits at their discretion.
Article 11. List of chemicals, biologicals and microorganisms prohibited for use in the formulation of aquatic feeds and aqua environmental remediation products; list of chemicals, biologicals, microorganisms and ingredients contained in aquatic feeds permitted for use in Vietnam; technical indicators that must be included in applicable standards of aquatic feeds and aqua environmental remediation products
1. List of chemicals, biologicals and microorganisms prohibited for use in the formulation of aquatic feeds and aqua environmental remediation products shall be subject to regulations enshrined in the Appendix I hereto.
2. List of chemicals, biologicals, microorganisms and ingredients contained in aquatic feeds permitted for use in Vietnam shall be subject to regulations enshrined in the Appendix II hereto.
3. Technical indicators that must be included in applicable standards of aquatic feeds and aqua environmental remediation products shall be regulated in the Appendix IV hereto.
Chapter IV
UPDATE OF INFORMATION ABOUT AQUATIC FEEDS AND AQUA ENVIRONMENTAL REMEDIATION PRODUCTS
Article 12. Signing up for accounts used for accessing the national fishery data system and updating information about aquatic feeds and aqua environmental remediation products
1. Facilities manufacturing and imported aquatic feeds and aqua environmental remediation products shall have to sign up for accounts used for accessing the national fishery data system and provide updated information to sign up for these accounts, including:
a) Sign-in names which may be either enterprise codes or tax identification codes;
b) Information that must be provided to sign up for accounts shall comprise: Names of facilities, addressed of main offices, telephone numbers, email addresses, aquatic production addresses, manufacturing conditions and corporate types.
2. Before authorizing products for marketing, manufacturing and importing facilities must send information about aquatic feeds and aqua environmental remediation products as prescribed in Article 13 herein via accounts created under provisions of clause 1 of this Article.
Article 13. Information about aquatic feeds and aqua environmental remediation products
1. Information about domestically-manufactured aquatic feeds and aqua environmental remediation products shall include: Information about manufacturing locations and conditions; information about applicable standards by using the data given in the Appendix V hereto; information about regulatory conformance announcement; labels of products (scanned color copies); product quality test results.
2. Information about aquatic feeds and aqua environmental remediation products shall include: Information about manufacturing facilities, locations and conditions; information about applicable standards prescribed in the Appendix V hereto; information about regulatory conformance announcement; labels of products (scanned color copies of original labels and Vietnamese labels); certificates of free sale or equivalent documents that remain valid; product quality test results upon importation.
3. After receipt of information referred to in clause 1 and clause 2 of this Article, the national fishery data system shall automatically grant codes indicating receipt of these information to requesting facilities so that they inscribe these codes on their products to serve the needs of management and tracing of product origins. Codes of receipt shall be composed of 2 elements: AA-BBBBBB, including:
a) AA: Codes used for classifying aquatic feeds and aqua environmental remediation products: 01 indicates the code of an aquatic feed; 02 indicates the code of an aqua environmental remediation product; 03 indicates the code of a product used for both purposes of manufacturing of aquatic feeds and aqua environmental remediation products;
b) BBBBBB: This identical series of letters indicates the ordinal numbers of aquatic feed products or aqua environmental remediation products which range from 000001 to 999999.
4. Whenever there is any change in information which has been updated according to clause 1 and clause 2 of this Article, facilities shall have to update their information before selling their products on the market.
Article 14. Rules of naming of aquatic feeds and aqua environmental remediation products
Names of aquatic feeds and aqua environmental remediation products shall meet regulations enshrined in Article 11 of the Government's Decree No. 43/2017/ND-CP dated April 14, 2017 on commodity labels.
Chapter V
IMPLEMENTATION ORGANIZATION
Article 15. Responsibilities of entities concerned
1. Directorate of Fisheries:
a) Carry out the State management of aquatic breeds, aquatic feeds and aqua environmental remediation products nationwide. Provide professional and specialized directions and instructions related to the management of aquatic breeds, aquatic feeds and aqua environmental remediation products;
b) Conduct the inspection and audit of aquatic breeds, aquatic feeds and aqua environmental remediation products on a nationwide scale; carry out the inspection of responsibilities of provincial-level fishery regulatory authorities in charge of aquatic breeds, aquatic feeds and aqua environmental remediation products;
c) Provide organizations and individuals with the specialized training in inspection of conditions of facilities, collection of samples of aquatic breeds, aquatic feeds and aqua environmental remediation products; training, education and instructions related to conditions of manufacturing and management of quality of aquatic breeds, aquatic feeds and aqua environmental remediation products;
d) Review and revise information and submit updated information to the Ministry of Agriculture and Rural Development for its decision on promulgation of the followings: The list of chemicals, biologicals and microorganisms prohibited for use in the formulation of aquatic feeds and aqua environmental remediation products; the list of chemicals, biologicals, microorganisms and ingredients contained in aquatic feeds permitted for use in Vietnam;
dd) Receive and grant codes referred to in Article 13 herein and, simultaneously, post information about aquatic feeds and aqua environmental remediation products sent by manufacturing and importing facilities on the electronic information portal of the Directorate of Fisheries before authorizing these products for marketing in case the national fishery data system has not been established yet.
2. Provincial-level fishery regulatory authorities:
a) Exercise the state management of aquatic breeds, aquatic feeds and aqua environmental remediation products within their remit; carry out the inspection and audit of aquatic breeds, aquatic feeds and aqua environmental remediation products within their remit;
b) Provide training and education of legislative regulations on aquatic breeds, aquatic feeds and aqua environmental remediation within their remit;
c) Perform other tasks relating to the management of aquatic breeds, aquatic feeds and aqua environmental remediation products within their remit if these tasks are assigned by Directorate of Fisheries.
3. Aquatic feed and aqua environmental remediation product manufacturing and importing facilities:
a) Update information about aquatic feeds and aqua environmental remediation products before free sale on the market in accordance with regulations in force;
b) Make and submit periodic review reports on manufacturing and import of aquatic feeds and aqua environmental remediation products for the first 6 months of the reporting year prior to June 20 every year and annual reports prior to December 20 each year according to the sample reports given in the Appendix VI hereto.
4. Aquatic breeding and cultivation facilities:
a) Make and submit periodic review reports on breeding, cultivation and nursery of aquatic breeds for the first 6 months of the reporting year prior to June 20 every year and annual reports prior to December 20 each year according to the sample reports given in the Appendix VII hereto;
b) Send written notifications of use of parent aquatic breeds to provincial-level fishery regulatory authorities to request their management and oversight of their useful life.
Article 16. Implementary provisions
1. This Circular shall take effect from January 1, 2019.
2. This Circular shall replace the following documents:
a) Decision No. 10/2007/QD-BTS dated July 31, 2007 of the Minister of Fishery that issues the list of aquatic veterinary medicines and aqua environmental remediation products permitted for free sale in Vietnam;
b) Decision No. 06/2008/QD-BNN dated January 18, 2008 of the Minister of Agriculture and Rural Development on amendments and supplements to the list of aquatic veterinary medicines and aqua environmental remediation products permitted for free sale in Vietnam;
c) Decision No. 108/2008/QD-BNN dated November 6, 2008 of the Minister of Agriculture and Rural Development that introduces the supplementary list of aqua environmental remediation products permitted for free sale in Vietnam;
d) Decision No. 123/2008/QD-BNN dated December 29, 2008 of the Minister of Agriculture and Rural Development that introduces the list of mixed aquatic feeds permitted for free sale in Vietnam;
dd) Circular No. 57/2009/TT-BNNPTNT dated September 8, 2009 of the Minister of Agriculture and Rural Development that introduces the supplementary list of aqua environmental remediation products permitted for free sale in Vietnam;
e) Circular No. 67/2009/TT-BNNPTNT dated October 23, 2009 of the Minister of Agriculture and Rural Development that introduces the list of mixed animal feeds permitted for free sale in Vietnam;
g) Circular No. 71/2009/TT-BNNPTNT dated November 10, 2009 of the Minister of Agriculture and Rural Development that introduces the supplementary list of aqua environmental remediation products permitted for free sale in Vietnam;
h) Circular No. 74/2009/TT-BNNPTNT dated November 20, 2009 of the Minister of Agriculture and Rural Development that introduces the supplementary list of mixed animal feeds permitted for free sale in Vietnam;
i) Circular No. 12/2010/TT-BNNPTNT dated March 11, 2010 of the Minister of Agriculture and Rural Development that introduces the supplementary list of aqua environmental remediation products permitted for free sale in Vietnam;

o) Circular No. 04/2012/TT-BNNPTNT dated January 16, 2012 of the Minister of Agriculture and Rural Development on removal of products containing Cypermethrin and Deltamethrin from the list of aqua environmental remediation products and aquatic veterinary medicines permitted for free sale in Vietnam;
p) Circular No. 36/2012/TT-BNNPTNT dated July 30, 2012 of the Minister of Agriculture and Rural Development that introduces the revised and updated list of aquatic feed products permitted for free sale in Vietnam;

t) Circular No. 09/2013/TT-BNNPTNT dated January 31, 2013 of the Minister of Agriculture and Rural Development that introduces the revised and updated list of aqua environmental remediation products permitted for free sale in Vietnam;
u) Circular No. 39/2013/TT-BNNPTNT dated August 12, 2013 of the Minister of Agriculture and Rural Development that introduces the revised and updated list of aquatic feeds and aqua environmental remediation products permitted for free sale in Vietnam;
ư) Circular No. 11/2014/TT-BNNPTNT dated April 1, 2014 of the Minister of Agriculture and Rural Development that amends and revises the Appendix 4 to the Circular No. 26/2013/TT-BNNPTNT dated May 22, 2013 of the Minister of Agriculture and Rural Development on management of aquatic breeds.
3. This Circular shall repeal the following regulations and documents:
a) Decision No. 176/QD-BTS dated March 1, 2006 of the Minister of Fishery that adopt certain temporary regulations on whiteleg shrimps;
b) Decision No. 456/QD-BNN-NTTS dated February 4, 2008 of the Minister of Agriculture and Rural Development prescribing requirements for breeding and culture of whiteleg shrimps;
c) Decision No. 1673/QD-BNN-TCTS dated July 22, 2013 of the Minister of Agriculture and Rural Development that adopts regulations on management of parent pangasius fish used for breed selection;
d) The words such as “Saponin” from tea seed powder and “Rotenon” respectively numbered 14 and 15 in the Appendix XLIV to the Circular No. 13/2016/TT-BNNPTNT dated June 2, 2016 of the Minister of Agriculture and Rural Development prescribing the management of veterinary medicines;
dd) Clause 6 of Article 3, Article 31 and Article 32 in the Circular No. 04/2015/TT-BNNPTNT dated February 12, 2015 of the Minister of Agriculture and Rural Development providing instructions on implementation of provisions of the Government’s Decree No. 187/2013/ND-CP dated November 20, 2013 elaborating on implementation of the Law on Commerce regarding international trades and intermediaries, purchase, sale, toll manufacturing and transit of agricultural, forestry and fishery goods across borders;
e) Regulations regarding the management of aquatic feeds in the Circular No. 20/2017/TT-BNNPTNT dated November 10, 2017 of the Minister of Agriculture and Rural Development providing instructions on implementation of the Government’s Decree No. 39/2017/ND-CP dated April 4, 2017 on the management of animal and aquatic feeds.
Article 17. Transitional provisions
1. Aquatic feeds and aqua environmental remediation products that were endorsed for free sale prior to the entry into force of this Circular shall be allowed to continue to be manufactured and imported till January 1, 2020, authorized for free sale and used until their useful life expires.
2. Products containing Saponin extracted from tea seed powder and Rotenon that were authorized for free sale under the provisions of the Circular No. 13/2016/TT-BNNPTNT dated June 2, 2016 of the Minister of Agriculture and Rural Development prescribing the management of veterinary medicines prior to the entry into force of this Circular shall be allowed to continue to be manufactured and imported till the expiry date of the Certificate of free sale for veterinary medicines, and used until their useful life ends.
Article 18. Implementary responsibilities
1. If documents used as references herein are revised, amended or replaced, new versions thereof shall be applied.
2. In the course of implementation of this Circular, if there is any difficulty or problem likely to arise, organizations and individuals must report on time to the Directorate of Fisheries for its consolidation and preparation of a final report to the Ministry of Agriculture and Rural Development to request the grant of decision on appropriate amendments and supplements./.
