Pursuant to the Government’s Decree No. 95/2022/ND-CP dated November 15th 2022 on functions, tasks, powers and organizational structure of the Ministry of Health;
Pursuant to the Government’s Decree No. 106/2020/ND-CP dated September 10th 2020 on job positions and quantities of workers in public service providers;
At request of the Director of Organization and Personnel Department, the Ministry of Health;
The Minister of Health promulgates a Circular on job positions, hiring quotas, structure of public employees by job titles in public health service providers.
Article 1. Scope and regulated entities

2. Regulated entities
a) Medical examination and treatment facilities (hereinafter referred to as "health facilities")
b) Centers for Disease Control (CDC) of provinces and centrally affiliated cities;
c) Medical centers of districts, districts, district-level towns, district-level cities (hereinafter referred to as "districts");
d) Emergency Centers 115;
dd) Laboratories testing pharmaceuticals, cosmetics, food;
e) Forensics centers, forensic psychiatry centers, medical assessment centers;
g) Relevant organizations and individuals.
3. This Circular does not apply to:

b) Assessment and payment of medical examination and treatment costs covered by health insurance.
4. Health facilities affiliated to other Ministries and central authorities, and non-public health facilities may also apply the instructions in this Circular according to their realities.
1. Job positions, hiring quotas, structure of public employees by job titles shall be determined according to the rules specified in Article 3 and Article 4 of the Government’s Decree No. 106/2020/ND-CP dated September 10th 2020 on job positions and quantities of workers in public service providers.
2. The minimum quantity of workers in a health facility shall be determined according to the quantity of hospital beds, which is approved and adjusted according to the average hospital bed occupancy of the last 03 years; The minimum quantity of workers of a preventive healthcare facility or medical assessment center shall be determined according to population and adjusted according to the characteristics, professional requirements and workload of each facility, and geographical, economic and social characteristics of each area; The minimum quantity of workers of a testing laboratory shall be determined and adjusted according to the average number of specimens tested in the year; The minimum quantity of workers of an Emergency Centers 115 shall be determined according to its ambulance norm.
3. The hiring quotas prescribed in this Circular are the minimum quantity of workers each public health service provider needs to ensure medical service quality and interests of their public employers and workers in terms of working hours and rest periods as prescribed by law. Depending on their workload and financial capacity, public health service providers may hire more workers to improve their service quality and ensure efficiency.
4. The hiring quotas prescribed by this Circular are the basis for health facilities to develop their annual personnel plans.

- Provincial CDCs having international quarantine operation: 15 more workers than hiring quota or each provincial CDC. If the province has 02 or more border checkpoints, each border checkpoint shall have 05 more workers, each opening shall have 03 more workers.
- If the province has industrial zones, economic zones: the provincial CDC shall have at least 06 more workers.
- For mountainous provinces: The hiring quotas of the provincial workplace union shall be multiplied by (x) 1,3.

+ Quantity of workers in departments specialized in preventive medicine, food safety and population, to which Table 5 shall apply;
+ Quantity of workers of the polyclinic (at the Center or in the district) by visits: 01 worker for 4.000 - 6.000 visits/year.

b) Hiring quota of the medical station of a commune is 05 workers/station
* Coefficient:
- By population
+ For medical stations in Region I and Region II with over 6.000 people, if the population increases by 2.000 – 3.000 people, 01 more worker shall be added;
+ For medical stations in Region II with over 5.000 people, if the population increases by 1.000, 01 more worker shall be added.
- By geographical area:
+ Hiring quotas of medical stations in Region II shall be multiplied by (x) 1,2.

b) Public health service providers that do not have enough workers shall have plans for recruitment and arrangement of public employees to reach the hiring quotas prescribed by this Circular before December 31st 2025.
Article 12. Implementation responsibilities
1. Organization and Personnel Department – the Ministry of Health shall take charge of shall supervise and inspect the implementation of this Circular.
2. Agencies and organizations affiliated to the Ministry of Health and assigned to carry out state management of healthcare, specialized agencies affiliated to the People’s Committees of provinces and assigned to carry out state management of healthcare, public health service provider, relevant organizations and individuals are responsible for the implementation of this Circular.
3. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Health for consideration and guidance./.
