DECREE

ON THE NATIONAL UNIVERSITIES

THE GOVERNMENT

Pursuant to the Law on Organization of the Government of September 30, 1992;
Pursuant to the Education Law of December 2, 1998;
Pursuant to the Government’s Decree No. 43/2000/ND-CP of August 30, 2000 detailing and guiding the implementation of a number of articles of the Education Law;
At the proposals of the Minister-Chairman of the Government Commission for Organization and Personnel and the Minister of Education and Training,

DECREES:

Article 1.- The National Universities are multi-branch and multi-field centers for high-quality tertiary and post-graduate training, as well as scientific and technological research and application.

The National Universities are entitled to take initiative in their activities concerning training, scientific and technological research, finance, international relations and organizational structure.

Article 2.- The National Universities have legal person status, their own seals and accounts; act as the main bodies to be assigned annual plan norms.

Article 3.- The National Universities are subject to State management by the Ministry of Education and Training, other ministries and branches, and the People’s Committees of the localities where they are located, within the scope of their respective functions as prescribed by the Government and in accordance with law provisions.

Article 4.- The National Universities shall each be organizationally composed of:

1. Member units:

a/ Universities;

b/ Scientific and technological research institutes;

2. Attached units:

a/ Faculties;

b/ Scientific and technological research centers;

c/ Units in service of training, scientific research and application activities.

3. The Office and a number of functional boards assisting the director of the National University.

4. The Prime Minister shall decide the establishment, merger, division, splitting or dissolution of the units prescribed in Clause 1 of this Article.

Article 5.- The National Universities shall have the National University Councils with their composition being stipulated by the Prime Minister.

The National University Council shall collectively resolve the strategies, plannings and plans for development of the National University, the organization and working regulation of their member units, the attached faculties and scientific and technological research centers in line with the Regulation on organization and operation of the National University, promulgated by the Prime Minister.

Article 6.- Each National University shall have a director and deputy -directors. The National University directors and deputy directors shall be appointed and dismissed by the Prime Minister.

The National University directors are legal-person representatives, take responsibilities for all activities of their National Universities; organize the implementation of the resolutions of the National University Councils; decide the establishment, merger, division, splitting or dissolution of the units prescribed in Clauses 2 and 3, Article 4 of this Decree according to the Regulation on organization and operation of the National Universities.

Article 7.- The Prime Minister shall base himself on this Decrees provisions to decide the establishment, merger, division, splitting or dissolution of national universities; promulgate the Regulation on organization and operation of the National Universities.

Article 8.- This Decree takes effect 15 days after its signing. To annul the Government’s Decree No. 97/CP of December 10, 1993 on the establishment of Hanoi National University, Decree No. 16/CP of January 27, 1995 on the establishment of Ho Chi Minh City National University. To annul the previous stipulations contrary to this Decree.

Article 9.- The Minister of Education and Training, the Minister of Science, Technology and Environment, the Minister-Chairman of the Government Commission for Organization and Personnel, the ministers, the heads of the ministerial-level agencies and agencies attached to the Government, the presidents of the Peoples Committees of the provinces and centrally-run cities and the directors of the national universities shall have to implement this Decree.
