Công văn 3647/BHXH-CSXH năm 2016 hướng dẫn tạm thời thực hiện chế độ tai nạn lao động, bệnh nghề nghiệp theo quy định của Luật An toàn, vệ sinh lao động do Bảo hiểm xã hội Việt Nam ban hành

On July 7, 2016, the Ministry of Labor, War Invalids and Social Affairs promulgated Official Dispatch No. 2533/LDTBXH-ATLD on provisional guidelines for regulations on occupational accidents and occupational diseases in accordance with the Law on occupational safety and hygiene. Vietnam Social Security has sent copies of the Official Dispatch No. 2533/LDTBXH-ATLD to Social Security of provinces and central–affiliated cities (hereinafter referred to as provinces), Social Security of Ministry of National Defense, and Social Security of People’s Public Security for implementation. While awaiting amendments to regulations on documents and procedures for payment of social security benefits issued together with the Decision No. 636/QD-BHXH dated April 22, 2016, Vietnam Social Security requires Social Security of provinces, Social Security of Ministry of National Defense, and Social Security of People’s Public Security to comply with the following regulations:

1. In respect of documents and procedures for payout of occupational accident insurance, occupational disease insurance claimed by victims thereof who have undergone complete medical treatment and have been discharged from the hospital from July 1, 2016:

- With regard to claims on occupational accident insurance, the documents prescribed in Clause 3, Clause 6 Article 14 of Regulation on documents and procedures for payment of social security benefits issued together with Decision No. 636/ QD-BHXH dated April 22, 2016 and their guiding documents of Vietnam Social Security shall be eliminated;

- With regard to claims on occupational disease insurance, the documents consisting of the report of measurement of workplace hazards, or the measurement results of workplace conditions, or copies of excerpts therefrom as prescribed in Clause 3 Article 15 of Regulation on documents and procedures for payment of social security benefits issued together with Decision No. 636/ QD-BHXH shall be eliminated;

- With regard to claims on occupational accident insurance or occupational disease insurance (Form No. 5-HSB issued together with Decision No. 636/QD-BHXH), the following contents shall be added to the end of Point 1 of the form:

+ Regarding claims on occupational accident insurance: “Biên bản điều tra TNLĐ số ... ngày ... tháng ... năm ... của Đoàn điều tra TNLĐ cấp cơ sở (nếu do Đoàn điều tra TNLĐ cấp cơ sở thực hiện) hoặc cấp tỉnh (nếu do Đoàn điều tra TNLĐ cấp tỉnh thực hiện) hoặc cấp Trung ương (nếu do Đoàn điều tra TNLĐ cấp Trung ương thực hiện)” (“Occupational accident investigation report No. ..dated ……….of an occupational accident investigation group at the grassroots level (if relevant), or of province (if relevant), or of central government (if relevant)”); in the case of traffic accident that is considered as an occupational accident, the following contents should be added: “(biên bản khám nghiệm hiện trường và sơ đồ hiện trường vụ tai nạn lập ngày ... tháng ... năm ... của ...)” (“(a scene examination report and an accident scene diagram made on………by………)”);

+ Regarding claims on occupational disease insurance: “Biên bản đo đạc môi trường có yếu tố độc hại (nếu là biên bản đo đạc môi trường) hoặc kết quả đo, kiểm tra môi trường lao động (nếu là kết quả đo, kiểm tra môi trường) hoặc kết quả quan trắc môi trường lao động (nếu là kết quả quan trắc môi trường) số ... ngày ... tháng ... năm ... của ...” (“Report of measurement of workplace hazards (if relevant), or measurement results of workplace conditions (if relevant) or occupational environment monitoring results (if relevant) No. …dated……..by……”)

2. In respect of occupational accident insurance and occupational disease insurance related to injury/disease relapse or injuries/diseases subject to overall assessment, the guiding documents issued before July 1, 2016 shall apply.

Difficulties that arise during the implementation of this Official Dispatch should be reported to Vietnam Social Security for consideration./.
